Res 092-2008 6/17/2008 RESOLUTION NO. "ly aocg RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING IMPLEMENTATION OF A PASSENGER FACILITY CHARGE AT WICHITA FALLS MUNICIPAL AIRPORT; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls operates, maintains and develops both Wichita Falls Municipal Airport and Kickapoo Downtown Airport with federal grants, user fees and other local funds; and WHEREAS, a Passenger Facility Charge (PFC) is a user fee authorized by Federal Law and imposed only on eligible enplaned passengers using commercial service airports; and WHEREAS, the Airport Advisory Board after thorough investigation and having held a public meeting on the feasibility of PFCs recommended to the City Council that the funds generated by adopting and collecting a PFC are needed to accomplish projects designed to enhance the capacity, safety and development of the Airports. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City Manager is authorized to file an application with the Federal Aviation Administration, authorizing the imposition of a Passenger Facility Charge (PFC) at the Wichita Falls Municipal Airport, and the expenditures of revenues from the PFC at both of the Airports, in accordance with each Airport's Capital Improvement Program, and the assurances and understandings contained in the application. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law.
