RESOLUTION NO. 1-2008
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY
DOCUMENTS TO FACILITATE THE EXCHANGE OF TRUSTEE PROPERTIES
WITH FLOOD VICTIMS; FINDING AND DETERMINING THAT THE MEETING
AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC
AS REQUIRED BY LAW.
WHEREAS, in late June and early July 2007 the Wichita Falls community suffered a
flood that was declared to be a federal disaster; and
WHEREAS, the City Council wishes to aid flood victims in their long term recovery
efforts and to generally reduce the potential for flood damage within the community; and
WHEREAS, Local Government Code Section 272.001(g) allows a political subdivision to
exchange property for the development of low/moderate income housing; and
WHEREAS, Local Government Code Section 272.001 (g) also allows the property to be
conveyed for less than its fair market value, as long as the conveyance serves a public
purpose,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. the City Manager or his designee is hereby authorized to execute
documents to facilitate the exchange of properties that meet the overall Local Government
Code conditions.
SECTION 2. It is hereby officially found and determined that the meeting at which this
resolution was passed was open to the public as required by law.

COUNTYOF WICHITA
WHEREAS, the City of Wichita Falis serves as trustee for tax foreclosed properties
owned jointly by WFISD, Wichita County, and the City of Wichita Falls; and
WHEREAS, Local Government Code Section 272.001(g) allows a political subdivision
to exchange property for the development of low-income or moderate-income housing; and
WHEREAS, Local Government Code Section 272.001(g) also allows the property to be
conveyed for less than its fair market value, as long as the conveyance serves a public
purpose;
WHEREAS, the CO of Wichita Falls requests authority to exchange the properties listed in
Exhibit "A" with certain residents living in the flood plain,
NOW, THEREFORE BE IT RESOLVED, that the Board of Trustees of the Wichita
Fails Independent School District does hereby authorize the City of Wichita Falls, as trustee of
the tax foreclosed properties described in Exhibit "A", to exchange such properties with
properties owned by certain residents living in the flood plain.
