Res 005-2017 1/17/2017Resolution No. _05-2017_ Resolution approving a Meet and Confer Agreement to modify Section 143.028(a) of the Texas Local Government Code (Municipal Civil Service) and modifying Section 143.028 of the City of Wichita Falls’ Firefighters and Police Officers’ Civil Service Rules relating to the Promotional Eligibility of Firefighters WHEREAS, the Fire Fighters’ Association, City staff and City Administration met under the Meet and Confer process on January 5, 2017; and, WHEREAS, one of the topics discussed under Meet and Confer was the Fire Association’s request to modify Section 143.028(a) of the Texas Local Government Code (Municipal Civil Service) and Section 143.028 of the City of Wichita Falls’ Firefighters and Police Officers’ Civil Service Rules rela ting to the Promotional Eligibility of Firefighters, to provide that a fire fighter would not be eligible for promotion to the position of Fire Equipment Operator unless he/she has served in the rank of Fire Fighter for at least five years at any time before the date the promotional examination is held; and, WHEREAS, the purpose of such modification is to ensure there is sufficient experience gained by said fire fighters before they move up the ranks, and thus provide an extra level of safety to the Department and the community. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. The City Council of the City of Wichita Falls, Texas, approves the attached Meet and Confer Agreement between the City and the Fire Fighters’ Association. 2. This agreement is not applicable to those personnel classified as Fire Fighters as of the date this Agreement is ratified by the City Council. 3. The agreement will continue in effect unless and until either party takes affirmative action to terminate same as specified in the agreement.
