Min 01/15/2008 242 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building January 15, 2008 Item 1 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the following members present: Lanham Lyne - Mayor Ray Gonzalez - Mayor Pro Tern Councilors Glenn Barham - Michael Smith - Dorothy Roberts-Burns - Rick Hatcher - Charles Elmore - Darron Leiker - City Manager Bill Sullivan - City Attorney Lydia Ozuna - City Clerk Mayor called the meeting to order. Item 2a Reverend Floyd Stevenson, Mount Zion Baptist Church, gave the invocation. Item 2b Councilor Gonzalez led in the Pledge of Allegiance. Item 3 Mayor proclaimed the month of January 2008 as "International Crime Stoppers Month" and encouraged all citizens to join Crime Stoppers in their efforts. Wichita Falls Crime Stoppers President Jennifer Mercer, Officer Melvin Joyner, and Officer Harold McClure accepted the proclamation and expressed appreciation to the City Council and thanked all citizens for their support. Item 4 Jessie Klein, 1125 Sunset Lane, asked Council to amend the animal ordinance to allow for non-human primates less than 15 pounds. Deborah Fitzgerald, 1153 Fell Lane, mentioned a grass fire on Fell Lane and that there is no fire hydrant there. She mentioned that there are only three residences out there. She asked Council to consider placing a fire hydrant on Fell Lane. Item 5a Minutes of the December 18, 2007 City Council meeting were approved as distributed. 243 Item 5b Minutes of the January 2, 2008 City Council meeting were approved as distributed. Moved by Councilor Roberts-Burns that Ordinance No. 4-2008 be passed. Motion seconded by Councilor Elmore. Mayor commented that they had spent a lot of time at the last Council meeting discussing this item. He expressed appreciation for all the time and effort on this by the City Manager, City Attorney, and Fire Local 432; many hours have been spent handling this matter. 244 Item 6c continued Motion carried by the following vote. Ayes: Mayor Lyne, Councilors Barham, Smith, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Item 7a RESOLUTION NO. 2-2008 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING THE APPROVAL OF THE STORM WATER MANAGEMENT PLAN FOR IMPLEMENTATION AND TO FORWARD TO TEXAS COMMISSION ON ENVIRONMENTAL QUALITY TO APPLY FOR PHASE II MUNICIPAL SEPARATE STORM SEWER SYSTEM PERMIT.; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. Moved by Councilor Hatcher that Resolution No. 2-2008 be passed. Motion seconded by Councilor Elmore. Mr. Curtis Beitel, Jacobs Burgess-Carter Engineers, went over the Storm Water Management Plan detailing the terminology, background on National Pollutant Discharge Elimination System, and Texas Pollutant Discharge Elimination System requirements. Mr. Scott Taylor pointed out that we are not required to perform any testing under Phase II; the Texas Commission on Environmental Quality makes sure that we are complying with what we said we would do. Mr. Beitel stated that they think the program they have for the City of Wichita Falls is very solid. Mr. Beitel continued his presentation of the Plan in the following areas: Implementation Schedule, and Storm Water Management Program Development. Mr. Taylor pointed out that our public involvement is the Water Resources Commission. Other areas covered by Mr. Beitel were minimum control measures, public participation and involvement, illicit discharge-detection/elimination, construction site runoff control and Storm Water Management Program implementation costs. He informed that Year One cost would be $1.1 million, which is 94% existing activities; and Year Five would be $1.3 million. Mr. Taylor informed that the $1.1 million (94% existing activities) was already accounted for in the budget and any expenses that are incurred are eligible out of the Storm Water Fund. These are not new dollars; very few new dollars will be put into this program in Year One. We will not be asking for an infusion of money or any increase of staff at this time. Current staff will be assigned these tasks. Motion carried by the following vote. Ayes: Mayor Lyne, Councilors Barham, Smith, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Item 7d RESOLUTION NO. 5-2008 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING THE PURCHASE OF 972 YARD WASTE CARTS AND 1,944 REFUSE CARTS FROM REHRIG PACIFIC COMPANY, IN THE AMOUNT OF $143,564.40, THROUGH THE BUY BOARD PURCHASING COOPERATIVE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. Moved by Councilor Roberts-Burns that Resolution No. 5-2008 be passed. Motion seconded by Councilor Gonzalez and carried by the following vote. Ayes: Mayor Lyne, Councilors Barham, Smith, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Item 8a City Manager commented that Council asked staff to look at the possibility of amending the animal ordinance to allow for the legal possession of small monkeys, 15 pounds or less and Council has been provided a draft ordinance. Also, a couple of 246 Item 8a continued boards met and discussed this, and Mrs. Franklin will report on that as well as summarize what the draft ordinance will do. City Manager asked Council for feedback to see if they want that draft on the next Council agenda or if they want to make any changes to the draft. Mrs. Lou Franklin, Health Department Director, informed that they had researched animal ordinances in other cities and based on those ordinances they have developed language that would need to be added to the current animal ordinance to allow for non-human primates less than fifteen pounds. She reported that they added two definitions as follows— 1) animals considered high risk for rabies and 2) regulated animals. We thought it was better to provide a broad definition rather than to limit it to non human primates. Language was also added to prevent inhumane treatment of extracting teeth to keep an animal from biting. A section was added outlining the guidelines to keep a regulated animal. She detailed these guidelines. We feel these are the minimum requirements necessary to protect health and welfare of citizens if regulated animals are allowed in the community and insure humane treatment of the animals. Mrs. Amy Cone summarized the Animal Shelter Committee meeting. Two questions were posed: 1) If the animal ordinance was amended with the changes of regulated animals would they recommend changes and 2) If limited to non-human primates, would they still agree to those changes? The Animal Shelter Committee said that they would not be able to house those animals because of caging requirements by the State. Also, holding animals would have to be three days or would have to amend the contract with the Humane Society, which is an issue. Significant lack of training by the staff in handling these animals is a concern and their staff would have to receive training. Dr. Julie Gibson, Animal Shelter Committee member, brought up communicable diseases. It is a big concern to us. No veterinarians in town are or want to handle treating those animals. If the draft ordinance passes they recommend they meet such high regulations so that we would be able to control what was in our population in ownership and such. Mrs. Cone informed that Mrs. Marty Maxwell, board member, brought up the concern of removing the young non-human primates from their mother at a very early age to be placed with new families. Once they have bonded with a family they do not bond with another new family. Monkeys cannot be put up for adoption because they do not bond. Mrs. Cone reported that the Board of Health had met and discussed this issue. Dr. Kathy Sultemeier, Board member, has worked with monkeys for over a year and is very familiar with monkeys. While she did treat some monkeys when she first came here, she will no longer treat monkeys because the only time someone can work with a monkey is if they are happy. Dr. Richard Sutton, Board Chair, pointed out that monkeys bite and bites are very difficult to treat. Mrs. Cone informed that the Board of Health voted unanimously that it was a bad idea to amend the animal ordinance and recommend not amending the current animal ordinance. Councilor Barham asked about the use of monkeys as service animals like dogs for the blind. Mrs. Franklin replied that they would be considered service animals and there is a provision for service animals in the current animal ordinance. Councilor Gonzalez stated that he agrees leaving the animal ordinance as is. There were too many negatives in amending the current ordinance in that these type of animals are regulated and not allowed Councilor Smith empathized with those folks who have monkeys in our City, however, there was an existing City Ordinance that this type of animals are regulated and not allowed. Everything considered I would be in agreement to keep the animal ordinance as is. When you have a group of experts, who work with animals, recommend to leave it as is then I would agree with that. Councilor Elmore said he had originally asked for a definition change to include non-human primates over 15 pounds. It went from that that to all wild animals over 15 pounds. It was blown out of proportion. The real key here is 'can I have a small organ grinder monkey in my house if I have adequate control and am doing proper care of this animal'. We know they are here and people do own them, and if we got the capability of licensing these particular animals, knowing where they are and that they are properly cared for. Animal Control has never had a monkey come in. I know they have communicable diseases and that is a big concern. Although there are no veterinarians 247 Item 8a continued here to care for these animals, there are veterinarians in Oklahoma City and Dallas that care for this particular type of animal. I understand everybody in the Humane Society, Animal Control Center, and the Health Department is adamantly opposed to changing this ordinance. We have animals that are a lot more dangerous than this little monkey that reside in the City. If someone wants to have a monkey and there is adequate control and care of the animal, I see no problem with someone having one. If they are not adequately cared for and controlled there should be adequate recourse to make sure that is taken care of. I believe people have a right to their property. I would still like to see a definition change. Mayor Lyne expressed appreciation to Mrs. Franklin, her staff and the Boards for their work. City Manager stated that he is still looking for direction from Council if there is enough interest in putting this on the agenda. Mayor suggested that this be discussed at the Strategic Planning meeting next week. Item 8b Councilor Roberts-Burns asked for an update on the request for start up funds for the flood victims. Mayor informed that they had a very long conference call with state and federal folks but every time we found the money it would disappear as you went through the regulations. Mr. Dave Clark stated that they had met with a representative from Congressman Mac Thornberry's office and had a conference call with HUD. It appears there is not going to be an easy solution. We still have an application with FEMA and do not know where that is going to go. I believe the HUD funding is so onerous when it comes to this kind of thing that I doubt that we end up using HUD funds on these properties. The regulations are just ridiculous. I encouraged the Wichita Falls Area Disaster Recovery Committee to do private fund raising to help the victims within the area that want to remain in their homes and have less than 50 % damage. The best route for them is to garner volunteer resources and volunteer folks to do repairs, and to raise private funding to help with those repairs. The Committee needs to stress the issue that there will not be programs to help everyone. They best use their private resources and move on with some things. They may have to recognize if they were a homeowner that they may not be able to be a home owner. It is a hard thing to say and it is difficult. In addition, the City is still left with the issue of having to review the houses standing there and begin the demolition process. Mayor commented that he had never been so frustrated in his life. We were on the phone for one hour and even people who would volunteer to give us their houses; we could not use the money from that. The federal regulations have become so onerous that they have all this money they want to give us that we cannot use. There are just a lot of things that are just wrong. It is just ridiculous; almost immoral. Councilor Roberts-Burns asked if the money had to come from federal funding. Mr. Clark and the Mayor replied that it could come from General Fund. City Manager said that they left that meeting with the idea that Mr. Mark Lundgren, Congressman' Thorn berry's office, would try to make calls to Washington to get our FEMA application processed through. So we will know exactly what we are dealing with on the Mitigation Program because we are probably going to have to come back to Council and ask for significant General Fund dollars just to deal with that program. We do not want to take on additional until that picture is clear because it could be several hundred thousand dollars that the City has to take out of the General Fund to deal with the homes that were flooded. The request from the Wichita Falls Area Disaster Recovery Committee was start up money for this organization. My understanding is that they already have some money and have hired a staff person that is being paid from that money. It is also my understanding that some of the flood victims have received some FEMA money and this is in addition to that. There are no federal programs applicable to that. The City could apply General Fund dollars, but keep in mind that you are going to be asked several times over for that out of General Fund. Mr. Clark stated that ultimately there is a 25% match that the City would have to come up with out of General Fund and that will be in the area of$200,000. If this all comes through, that leverage is another 75% of that; it is roughly an $800,000 application. It is of value to us to see what the federal government and FEMA say about our application. Meanwhile, the houses get worse and worse. 248 Item 8b continued Councilor Roberts-Burns thanked Mr. Scott Taylor for the work on the River Road Project. Councilor Roberts-Burns reminded that the Martin Luther King and Scholarship Breakfast would be this Saturday, January 19 at MPEC. Tickets are still on sale. Councilor Elmore reported that he held the District 5 town hall meeting at Kate Haynes and thanked those who attended. He is looking forward to next month's town hall meeting with the Mayor. Councilor Elmore asked staff to check on a large dog that is loose quite often on Thelma Street. He also mentioned that there were gang signs in that area and asked that staff look into that to see what we can do about that. Councilor Barham stated that Mrs. Ward, Wichita falls Area Disaster Recovery Committee, is asking for start-up funds to replace stoves, refrigerators, etc. not to replace the flood victims' homes. He thought we should find some money to help this Committee. This is to help folks that are in dire straits. I think we should try to find money wherever we can. Councilor Barham mentioned that at the last Mayor's town hall meeting the acronym "MONTH" was mentioned which stands for the Museums of North Texas History. They are doing good things out there and are making a lot of effort to make it a place for tourists and citizens to visit. He asked everyone to check that place out. He plans to do that soon. Councilor Hatcher said that his heart goes out to the flood victims, and commented that this is a caring and helpful community and people have always stepped up to help. He asked those that are watching to help these people. That is what we are good at. He mentioned an Eagle Scout project and commented that it is amazing what can be done through organization and by contacting people in the community. This Scout was able to furnish a home with 50% flood damage with appliances, rebuild the roof and basically rebuild the house all with volunteer work. I encourage people with this need to contact the North Texas Boy Scout Council and let them know your needs. The Boy Scouts are looking for Eagle Projects. You can get that stuff done. He encouraged the Community to step up and help. The City cannot fund it because of the regulations. There might be some real good Eagle Scout Projects out there. Councilor Gonzalez thanked his constituency who attended the District 4 town hall meeting. Good things came out of it, and one thing was the Museum. We have several good museums here in Wichita Falls, the Fire and Police Museum, the Curtis Jenny Airplane, etc. There was talk about combining all these where we would have one central museum. We need to advertise these museums more often. The previous Convention Visitor's Bureau Director was getting good exposure for the museums through the Visitors Bureau pamphlet. I think that is a good idea. Mr. Bob Sullivan informed that they had a luncheon for all the attractions in town, which is something they are going to do quarterly. We have a new website for the CVB and we want to combine our efforts to talk about how we can collectively get the word out and do some marketing and highlighting the attractions and hotels in town. We are pushing towards that. Mr. Clark mentioned that a coordination meeting has been set to look into combining these museums. Councilor Gonzalez felt that town hall meetings were good because we hear from the citizens as to what they are thinking and want done. Councilor Gonzalez suggested that a check list be placed on the back of our water bill relating to leaks to assist citizens. Mr. Scott Taylor informed that they had talked about a pamphlet to be provided to new users; we will get a short check list of leak checks and put on the back of the water bill. The Water Resources Commission is working on new pamphlets related to that. Councilor Smith was in support of helping the Wichita Falls Area Disaster Committee. That group is alone to respond to those needs. He thought we should look at that further and if we need to get the funds from General Fund so be it. He asked Council to talk more about that at their Strategic Planning meeting next week. We are not getting any help from the feds and we will need to do it on our own like we are used to doing in a lot of situations. . Councilor Smith referred to the new Sidewalk Ordinance and the fact that the trash receptacles cannot be placed on the sidewalk. He asked if the trash collection operators placed the receptacles back to where they are picked up. Mr. Taylor explained that the 249 Item 8b continued process is automatic so after the cart is raised to empty the refuse it is placed back to the same location. Councilor Smith referred to the Storm Water System booklet and asked if we were going to put decals, etc. in the inlets and outlets. Mr. Taylor replied that they were going to do that. His staff will contact volunteer organizations and we will provide the material and training. The volunteers will do that or the Street Department can routinely do that. We will be following the larger cities in using those stencils. Councilor Smith referred to the animal control issue and he thought the staff is correct in what they recommended but he still has a concern about the person and many people who own animals of this sort. He supports that this be placed on the agenda. He thinks these animal owners should be able to come before the Council. He asked where do the rights of citizens begin and the right to govern by the City? Council Barham concurred that it should be on the agenda. Mayor stated that since three councilors have agreed, it would be on the next agenda. Mayor Lyne asked for an update on our Mitigation Plan. Mr. Clark informed that our Mitigation Plan was originally submitted in February 2006 and then revised in October 2007. the revisions that are all inclusive have been in there since that time. It was originally done by Nortex, but there was a problem and then we got involved to solve it and put additional information which went through Nortex again. In the process multiple discussions were held with same people at the State. I hope that they do not want to play games. Mayor Lyne referred to the Storm Water Presentation and stated that one of his first jobs was picking up trash; it is a disgusting job. Trash is one of our biggest problems in storm water. My office backs up to Quail Creek and the trash starts on that Creek and travels to McNiel. What-a-Burger, Wal-Mart, Kohl's, Barwise, and behind his office building and on to Sikes Lake. After a rain Sikes Lake looks like a dump. Mayor Lyne receives calls from people that have property along that Creek telling him that the City needs to do something about that trash. His response is always the same - "When you can convince people to stop throwing trash out of their car windows that will stop a lot of that problem." Trash is a problem and a major pollutant, and it is a major cost to clean up but the solution is simple — put it in a trash receptacle. The land fill has plenty of room for that trash. People try to justify by saying that they are providing a job for someone to pick up that trash but Mayor Lyne says, "No, it is creating trash". It is so easy to prevent, there are many trash receptacles all over town where trash can be disposed of properly. There is no reason to throw trash out of your car windows. Mayor Lyne mentioned the Martin Luther King Prayer Breakfast noting that it is also a scholarship breakfast that makes a difference to a lot of young people to go to college. It is important as a society and our responsibility to make sure we educate people, and this is one way it is done. We need to thank Councilor Roberts-Burns for organizing and coordinating this. Mayor Lyne asked Chief Foster to meet with him after this meeting to discuss the request for a fire hydrant on Fell Lane. Mayor Lyne informed that he had received a letter from a 12 year old boy who wants to start a paint ball league. He will give the letter to Mr. Jack Murphy and asked him that he take it to the Park Board. He said the little boy suggested that we "think outside the box".
