Min 04/01/2008 291 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building April 1, 2008 Item 1 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the following members present: Lanham Lyne - Mayor Ray Gonzalez - Mayor Pro Tern Councilors Glenn Barham - Michael Smith - Dorothy Roberts-Burns - Rick Hatcher - Charles Elmore - Darron Leiker - City Manager Bill Sullivan - City Attorney Lydia Ozuna - City Clerk Mayor Lyne called the meeting to order. Item 2a Reverend Reggie Coe, Pastor Grace Church, gave the invocation. Item 2b Councilor Gonzalez led in the Pledge of Allegiance. Item 3a Mayor Lyne presented Honorary Wichita Falls Citizen Certificates to foreign exchange students from Brazil, Germany, Japan, Sweden, Czech Republic, Austria, Slovakia, and France. Each student expressed appreciation to their host families and stated how much they had enjoyed their stay here. Mayor presented them with City of Wichita Falls pins. Item 3b Mrs. Kate Teichman and members of the Wichita Falls Runners' Club presented the City with a check in the amount of$3,400, proceeds from the Trails Fest Event. They expressed a desire that these funds be used to continue the trails. Mayor Lyne and Mr. Jack Murphy accepted the check and expressed appreciation to the Runners Club. Item 3c Mr. Mike Miller, Automotive Mechanic in the Aviation, Traffic, & Transportation Fleet Maintenance, was recognized as Employee of the Month for April 2008. Mayor presented Mr. Miller with a plaque, a check, and restaurant certificates. Item 3d Mayor proclaimed April 7-13, 2008 as "Public Health Week" in Wichita Falls and urged citizens to extend a hand of thanks to public health professionals as they promote a healthy environment in our community. Health Director Lou Franklin invited everyone to attend the 292 Item 3d continued Health Fair April 12 at the Health Department from 9 a.m. to 1 p.m. This will be conducted inside and outside the facility and will also have pet activities. Item 3e Mayor proclaimed April 2008 as "Child Abuse Prevention Month" and encouraged citizens to recognize the compassionate and dedicated volunteers and professionals who try to bring help to these innocent victims. Mrs. Geneva Schroeder and members of the Child Welfare Board, Child Advocates, Patsy's House, and Child Protective Services workers were present to accept the proclamation. Item 3f Mayor Lyne presented the 2008 Patsy Baggett Children's Service Award to Mrs. Phyllis Hiraki, Executive Director for the Community Health Center, in recognition of her services to the families and children of our community and further applauds her sincere desire to improve the lives of our citizens. Mrs. Hiraki accepted the award and expressed appreciation for this recognition noting that this was not about one but about all the individuals at the Community Health Center, staff, nurses, doctors, everyone. She thanked everyone for the opportunity for the Community Center to serve in this community to help preserve the health of our patients, both young and old. Item 4 William Robinson, 2158 Avenue F, owner of Robinsons' Resale, expressed concern about the decaying of that area—graffiti, illegal drug sales and use, trash, dilapidated structures. He asked that Council help to address these situations. Mayor will get with the City Manager, and appropriate staff to see what can be done. Item 5 The March 18, 2008 minutes were approved as distributed. Item 6 City Manager gave a briefing on the item listed under the Consent Agenda. Ayes: Mayor Lyne, Councilors Barham, Smith, Roberts-Burns, Hatcher, Gonzalez, and Elmore Nays: None Item 6a RESOLUTION NO. 39-2008 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING THE PURCHASE OF THE CITY'S ESTIMATED ANNUAL REQUIREMENT OF AUTOMOTIVE LUBRICATING OILS AND GREASE FROM OLMSTEAD OIL IN THE AMOUNT OF $102,000.00; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. , 1 293 Item 7a ORDINANCE NO. 19-2008 ORDINANCE DECLARING UNOPPOSED CANDIDATES AS ELECTED TO THE MAYOR, COUNCILOR DISTRICT 3, AND COUNCILOR DISTRICT 5 POSITIONS AND DECLARING THOSE THREE ELECTIONS CANCELLED IN ACCORDANCE WITH CHAPTER 2 OF THE TEXAS ELECTION CODE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. This is a project of Leadership Wichita Falls Class of 2007 and the proceeds will go to Patsy's House, Faith Mission, and Downtown Development. Motion carried by the following vote. Moved by Councilor Gonzalez that Resolution No. 46-2008 be passed. Motion seconded by Councilor Smith. Councilor Barham asked that staff give the riders plenty of notice when the deviation cost would be increased; he suggested six months notice and plenty of advertising. Ayes: Mayor Lyne, Councilors Barham, Smith, Roberts-Burns, Hatcher, Gonzalez and Elmore Nays: None Item 8h RESOLUTION NO. 47-2008 RESOLUTION APPROVING CONSULTING SERVICES CONTRACT TO LEIBOWITZ & HORTON AIRPORTS MANAGEMENT CONSULTANTS INCORPORTED FOR THE DEVELOPMENT AND IMPLEMENTATION OF PASSENGER FACILITY CHARGES AT WICHITA FALLS MUNICIPAL AIRPORT AND MAKING AN APPROPRIATION OF $26,300 TO AIRPORT EQUITY TO COVER THE UNBUDGETED AMOUNT FOR THIS SERVICE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. Moved by Councilor Hatcher that Resolution No. 48-2008 be passed. Motion seconded by Councilor Barham and carried by the following vote. Ayes: Mayor Lyne, Councilors Barham, Smith, Roberts-Burns, Hatcher, Gonzalez and Elmore Nays: None Item 9a Mr. Scott Taylor announced that there would be a compost give away April 5 at the City's Landfill beginning at 9 a.m. and asked that these folks bring a tarp and identification that they reside in the City. Mr. Dave Clark gave a reminder about the two special Council Meetings—April 8, 2008 at the Library, Final Presentation of the Diversification Plan; and April 22, 2008 at the Library, Presentation of the Downtown Plan. Item 9b Councilor Roberts-Burns mentioned that the system at the River Road Plant was working; she has not smelled the odor. Mr. Taylor stated that the system is functioning and we are working on punch list items. We had a failure with some seals on one of the clarifiers and that is being addressed. The Contractor exceeded his contract time and we are still dealing with that and not ready to bring to Council yet. The system is working as designed. Councilor Roberts-Burns thanked Mrs. Lou Franklin and her staff for taking care of the dog issues on the north side a couple of weeks ago. Councilor Roberts-Burns informed that the Mayor's Town Hall Meeting would be held April 7 in District 2 at the Martin Luther King Center, and she invited everyone to attend. Councilor Elmore mentioned the first Citizens Fire Academy meeting and stated that it was very interesting and several of the attendees got on the ladder truck and his wife was one of them. He is delighted that we are in this process. We have a small class and plan for one a year. He encouraged anyone who is interested to make plans for the second class. We are really enjoying it. Councilor Elmore informed that next weekend the Citizens Police Academy Association is sponsoring the first"Gateway to Texas Softball Tournament" at the Softball Complex. The registration time has been extended. Currently we have twelve teams. This is the first one and we will be advertising this through all the softball tournaments for the year. We are going to continue this particular tournament in the future. He expressed appreciation to the persons in the Citizens Police Academy involved in this effort, including his wife. Councilor Barham stated that he had participated in the Mayor's Meals on Wheels March 19 along with Councilor Gonzalez and it was fascinating to watch them put 750 meals in 25 minutes. Actually, going out on one of the routes was touching when we delivered the meals. Some of those folks are in dire straits when it comes to meals; we should do anything we can do to support that organization in the future, and the public as well. It is a very needy project and money well spent. Councilor Barham said that at Oak Street at the railroad tracks east on Kell at the Indiana intersection, there is a like a speed bump on the east side that looks like a layer of asphalt. He asked staff to look into that. 298 Item 9b continued Councilor Barham talked to a citizen that lives at 1908 Barna and she commented about an ugly tree at the Golf Course. She asked if something could be done about that tree. City Manager said it was a tree and could be cut down. Councilor Barham was asked by Mrs. Christy Ridinger, Mane Event Committee member, what the process was to get some of the Mane Event Project horses on the medians. He directed Mrs. Ridinger to Mr. Jack Murphy on this matter. Councilor Hatcher gave a list of drop-off places for glass and plastic for recycling — United Market Street, Wal-Mart, and Transfer Station. Councilor Hatcher thanked everyone that was able to participate last Tuesday in Leadership Wichita Falls mock City Council meeting. He thanked Justice of the Peace Janice Sons for her participation. It was a fun time and was well attended. Councilor Hatcher reminded everyone that the TML Region V Meeting would be hosted by the City of Wichita Falls and would be held April 10, 2008 at 6:00 p.m. at MPEC. Youth Leadership Class will also be in attendance. TML President Pearson will be the guest speaker. Councilor Hatcher mentioned that his Leadership Class's project remains incomplete; the project was to refurbish Berend's Landing Bridge to tie into the Trails System. The City does not have money to do that, but he asked interested persons to contact him to find a way to do this, maybe a historical grant. Councilor Elmore said he would work with Councilor Hatcher to put together an organization to work on that. Councilor Gonzalez thanked Betty Brown for her part in the Meals on Wheels. It was a great turn out and he thanked her and her staff for all their efforts. Councilor Gonzalez asked if we had any Code Enforcement authority at West Lake Arrowhead. Mr. Clark replied that the only thing we have is those issues covered by a lease agreement; we can do that. Councilor Gonzalez stated that some lots are trashed up and asked if the leases covered that. Mr. Clark responded that they do and he will look into that. City Manager asked Councilor Gonzalez to provide staff with specific addresses to staff. Councilor Gonzalez thanked Mr. John Burrus and his staff for the quick action in resolving lighting issues in a neighborhood. Everybody is now happy in that neighborhood. Councilor Gonzalez mentioned that the TML Region V meeting would be hosted by the City of Wichita Falls and he would like to see a big turnout by Council and Staff. Councilor Gonzalez mentioned that one of his friends has a 32 year old daughter that has Muscular Dystrophy, is in a wheel chair, and has to be cared for by her parents and be everywhere they go, including the Senior Zone. There has been a conflict at the Senior Zone not allowing her there because she is not a senior citizen. He asked that this be looked into for an exception to allow her in there since she has to be with her parents. Councilor Smith thanked Joe Brown, Times Record News, for last week's newspaper column on good water, great twice a week trash pickup, and a great sewer system. I thank him for those comments. Councilor Smith stated that in District 1 we had light street outages and he thanked John Burrus and his staff; in particular Mark Beauchamp, who responded very rapidly and took care of it. Councilor Smith informed the citizens that they can report light outages in town by calling the Street Department at 761-7640 or the Police Department at night. That is a public safety issue. City Manager recommended that they use the City Hall Access System and it will go directly to the division responsible and they can get feed back. Councilor Smith said that they have talked about trash and plastic bags. A friend gave him a cloth bag and suggested using those instead of all those plastic bags. Councilor Smith also participated in the Meals on Wheels but was a few days late, but was still able to see that process and was amazed. They can generate assembly line meals. We went on a tour and delivered 30 meals and it was a great experience. Councilor Smith asked what the next step would be on the flooded homes. Mr. Clark informed that the next step is with the Mitigation Plan. He mentioned that our HUD monitor, who is our field representative, was here last week and we took her around to make sure she knew first hand what we are seeing and dealing with. I think it did make a good impression. She is someone who is very well aware of the regulations and knows what we can and cannot • 299 Item 9b continued do, but her hands are tied as well. Folks at the Fort Worth HUD Office who are in charge of relocation as well as others told us to tell our Congressman how the rules are. When it comes to demolition we have the funds available under CDBG, but we still do not have clearance on that since July. One thing she did monitor was the demolition; the result was that we were not doing anything wrong just more paperwork. We will be back to council to see if you want to consider some additional demolition. Councilor Smith mentioned the Board/Commission appreciation luncheon held yesterday at MPEC, and it was a great celebration. He also complimented Mayor Lyne for a great job at emceeing. He thanked the citizens who work on these boards/commissions. He mentioned that MPEC staff served a great meal. He thanked Bob Sullivan for his great hospitality. Mayor Lyne welcomed Ms. Penny Bridges to town as the new Convention &Visitors' Bureau Director. We look forward to great things happening in Wichita Falls. Mayor Lyne mentioned the thank you note received by the City Manager and sent to Council. It was a thank you note from Bill McMillan, Habitat Contractor expressing appreciation to the City in particular to Joe Franco. They had problems with the water sewer and they contacted the City and Joe Franco took care of it and Mr. McMillan appreciated the way it was handled with professionalism, politeness, and efficiency. Mayor congratulated Mr. Joe Franco and all the staff that assisted. Mayor Lyne received a copy of Out Door Life where they recognized Wichita Falls as one of the best 200 towns with outdoor activities. It was nice how they rated us in that and it was nice of Mr. James Burks to recognize us for that. City Council adjourned at 11:15a.m. PASSED AND APPROVED this day of 2008.
