RESOLUTION NO. 94-2011__
Resolution Authorizing The Purchase Of CISCO Computer Servers,
Software Licenses, And Related Equipment and Professional
Services From CDW Government, LLC For The City’s Primary
Telephone System In The Amount Of $86,241.92
WHEREAS, the City has been notified that the operating system of the City’s
Primary Telephone System will soon no longer be supported; and
WHEREAS, it is necessary to replace computer server equipment to run the
newer versions of the operating system, and staff recommends using a licensed
dealer/installer of CISCO equipment to migrate the existing data and reconfigure the
system;
WHEREAS, Texas Government Code§ 2054.0565 exempts items purchased
through the Texas Department of Information Resources from the State’s competitive
bidding requirements as follows:
Sec. 2054.0565. USE OF CONTRACTS BY OTHER ENTITIES. (a) The
department (Department of Information Resources) may include terms in a
procurement contract entered into by the department, including a contract entered
into under Section 2157.068, that allow the contract to be used by another state
agency, a political subdivision of this state, a governmental entity of another state,
or an assistance organization as defined by Section 2175.001.
(b) A political subdivision that purchases an item or service using a contract
under this section satisfies any other law requiring the political subdivision to
seek competitive bids for that item or service.

WHEREAS, CDW Government, LLC is a licensed dealer/installer of CISCO
equipment and is a vendor in the Texas Department of Information Resources
Cooperative Purchasing Program; and
WHEREAS, the City Council finds that the proposed purchases through the
Texas Department of Information Resources are exempt from Texas’ requirements for
competitive bidding pursuant to Texas Government Code §2054.0565, and the other
purchases described herein are exempt from Texas’ competitive bidding requirements
pursuant to Texas Local Gov’t Code § 252.021 because these procurements are (1)
necessary to preserve and protect the public health and safety of the City’s residents,
(2) professional services [consultant fees], and (3) available from only one source
because they are patented items, captive replacement parts, or components for
equipment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The City Manager is hereby authorized to execute all documents necessary to
purchase CISCO computer servers, software licenses and related equipment and
professional services from CDW Government, LLC, as described on the attached
Quote SheetStatement of Work
and , for the City’s Primary Telephone System in the
amount of $86,241.92.
