Min 08/05/2008 ` T 379 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building August 05, 2008 Item 1 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the following members present. Lanham Lyne - Mayor - Councilors Glenn Barham - Michael Smith - Rick Hatcher - Jim Ginnings - Charles Elmore - Dorothy Roberts-Burns - Darron Leiker - City Manager Bill Sullivan - City Attorney Lydia Ozuna - City Clerk Mayor Lyne called the meeting to order. Item 2a Reverend Kile Bateman, Pastor Evangel Temple Church, gave the invocation. Item 2b Councilor Ginnings led in the Pledge of Allegiance. Item 3 Officer Jeffery Hughes, Wichita Falls Police Department, was recognized as Employee of the Month for August 2008. Mayor presented Officer Hughes with a plaque, a check, and restaurant certificates. Item 4 No one signed up to speak under public comments. Items 5a-5b Minutes of the July 8, 2008 Special Council meeting and July 15, 2008 Regular Council meeting were approved as distributed. 380 Item 6 City Manager gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Elmore that the Consent Agenda be approved. Motion seconded by Councilor Barham and carried by the following vote. Ayes: Mayor Lyne, Councilors Barham, Smith, Roberts-Burns, Hatcher, Ginnings, and Elmore Nays: None Item 6a RESOLUTION NO. 117-2008 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, TO ACCEPT THE CYPRESS WATER TREATMENT PLANT 1.5 MG ELEVATED STORAGE TANK PROJECT, CWF06-544-07 AND AUTHORIZE FINAL PAYMENT TO LANDMARK STRUCTURES I, L.P.; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. Item 6b RESOLUTION NO. 118-2008 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING AWARD OF BID FOR FURNISHING AND INSTALLING AN EMERGENCY GENERATOR AT MEMORIAL AUDITORIUM TO MARVIN GROVES ELECTRIC IN THE AMOUNT OF $75,657.00; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. Item 7 Minutes of the April 9, 2008 MPO Technical Advisory Committee meeting were approved. Item 8a A public hearing was held to determine if certain buildings and/or structures to be dangerous. Mayor declared the public hearing open. Mr. Dave Clark provided information on the process leading up to presenting a list of hazardous structures to City Council. He informed that when Councilor Hatcher toured these structures with Staff he suggested providing a broader overview of the structures to show the surrounding areas, and this is now being done. Each structure on the list was addressed and time allowed for public comments. The following property owners requested additional time. Item 6: 511 Flood LeRoy Cleaver, Jr., owner, stated that he plans to fix this property as quickly as he can. He said he would also repair 802 Woods within a few days. Mayor stated that 511 Flood looks pretty far gone; it looks like it will be hard to rehabilitate and very expensive. Council's desire was not to remove it from the demolition list. Item 7: 802 Woods LeRoy Cleaver, Jr., owner, said he could pay the back taxes and rehabilitate it. Mr. Bobby Teague informed that the foundation is okay and has mainly sheetrock damage. Council expressed a desire to remove it from the demolition list and allow Mr. Cleaver 30 days to obtain a Restoration Permit and 120 days to show substantial progress. 381 Item 8 a continued Item 8: 1004 Woods Anna Bell Bennett Stephan resides at 1004 Woods and informed that she has done some clean up work on the yard, and she now has money to do something with her house. Council recommended that she be allowed 30 days to obtain a Restoration Permit and 120 days to show substantial progress. Item 12: 601 N. Beverly Mr. Teague informed that this property had been purchased by Gregory Chapa and Freddie Chapa, who reside at 3147 Southeast Drive. They asked for additional time to rehabilitate this structure. They have a contractor license to remodel. Council recommended 30 days to obtain a Restoration Permit and 120 days to show substantial progress. Item 13: 1300 Borland Johnny Lam representing his father Tuong Lam, property owner, informed that the structure just has smoke damage and they have quotes for repairs and want additional time to repair. Council recommended 30 days to obtain a Restoration Permit and 120 days to show substantial progress. Item 15: 1620 30t' Street Virginia Kent, 4501 Martinique, property owner, requested additional time to repair the structure. She has all the building material and a contractor. Council recommended 30 days to obtain a Restoration Permit and 120 days to show substantial progress Item 16: 1600 Lucille Mike Burch, 4632 Stanford, owner, stated that he was in negotiations with Jose Garcia to purchase this property and would like 60 days to complete the negotiations. He just began the negotiations. Council recommended 30 days and Mr. Burch is to contact Community Development staff and let them know the end result, otherwise it would remain on the list of structures to be demolished. Mr. Clark informed that there would be additional demolitions on this contract that have come in as trusteeships; however those do not require public hearing action. Councilor Elmore asked about the old Geico building on Old Burk Road across from Sheppard Air Force Base's gate; it needs to be on this list. Mr. Clark stated that it cannot be added to this list because notifications have to be sent out, but can put it on the next list. Mayor asked for additional comments. There being none, Mayor declared the public hearing closed. Item 8b ORDINANCE NO. 37-2008 ORDINANCE OF THE CITY OF WICHITA FALLS, TEXAS, FINDING CERTAIN BUILDINGS AND/OR STRUCTURES TO BE DANGEROUS; REQUIRING PROPERTY OWNERS TO DEMOLISH SAID BUILDINGS AND/OR STRUCTURES WITHIN THIRTY (30) DAYS OF THE DATE OF THIS ORDINANCE AND DECLARING AN EMERGENCY; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. Moved by Councilor Elmore that Ordinance No. 37-2008 be passed. Motion seconded by Councilor Smith. Item 10a RESOLUTION NO. 119-2008 RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE CITY OF ALLEN , TEXAS FOR THE PURCHASE OF CERTAIN SUPPLIES, EQUIPMENT AND SERVICES; DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. FOR THE CITY'S BANK DEPOSITORY SERVICES FOR A PERIOD OF FIVE YEARS; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. 384 Item 10b continued Moved by Councilor Barham that Resolution No. 120-2008 be passed. Ayes: Mayor Lyne, Councilors Barham, Roberts-Bums, Hatcher, Ginnings, and Elmore Nays: None Item 10c RESOLUTION NO. 121-2006 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, SUSPENDING THE AUGUST 8, 2008, EFFECTIVE DATE OF ONCOR ELECTRIC DELIVERY COMPANY'S REQUESTED RATE CHANGE TO PERMIT THE CITY TIME TO STUDY THE REQUEST AND TO ESTABLISH REASONABLE RATES; APPROVING COOPERATION WITH ONCOR CITIES STEERING COMMITTEE TO HIRE LEGAL AND CONSULTING SERVICES AND TO NEGOTIATE WITH THE COMPANY AND DIRECT ANY NECESSARY LITIGATION AND APPEALS; REQUIRING NOTICE OF THIS RESOLUTION TO THE COMPANY AND LEGAL COUNSEL FOR THE STEERING COMMITTEE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. Ayes: Mayor Lyne, Councilors Barham, Roberts-Burns, Hatcher, Ginnings, and Elmore Nays: None Item 11 a Chief Foster provided an update on the fire situation in the County. It is hot, dry, and windy and there are a lot of fires. He asked everyone to be very careful and safe with fire when grilling, smoking or anything. Item 11 b Councilor Roberts Burns asked staff to look into the property on Harding and Rosewood for Code violations; a lot of junk cars are out there. Councilor Roberts Burns mentioned that the structure on Juarez and Harding needs to be put on the demolition list. Councilor Roberts-Burns thanked those who attended the District 2 town hall meeting. She thanked Jamie Moore for the Code Red information he provided at the meeting. Councilor Elmore informed that a lot of the people in City View and District 5 who are retired failed to file for the federal government incentive check and time is running out. Many who are eligible have not filed for this money. Councilor Elmore said that he would like to pursue the proposal that the City apply to the Air Force Museum for an aircraft to be placed on a pedestal at the location of the "Fly Over" Expressway. He asked for other Council support. Mayor Lyne said he would like to see the concept on the cost, location, etc. Councilor Barham expressed his support as well. City Manager said they will see what can be done. 385 Item 11 b continued Mr. Jack Murphy informed that the City did have one of these aircrafts at Lake Wichita but it was removed after someone climbed the fence to get to the aircraft and was seriously injured. Councilor Ginnings suggested the Military Affairs Committee for possible financial assistance. Councilor Barham congratulated Mr. Jack Murphy on the Blue Grass Festival held at MPEC; good attendance and was well worth being inside. Councilor Hatcher did a good job of emceeing. Hope we can do it again inside next year. Councilor Barham gave kudos to Mr. Bob Sullivan and Penny Bridges and their staff on the magazine ads touting Wichita Falls. One ad was in the Texas Highways Magazine in conjunction with wineries throughout the state and the winery here in Wichita Falls. Penny Bridges is doing a good job; let's keep that up, it is much appreciated. Councilor Barham asked about the rodent problem at Sikes. City Attorney informed that we have responded to that situation and are in the process of resolving it. He will speak privately with Councilor Barham about this. Councilor Hatcher said he had a good time at the Blue Grass Festival and worked to stay away from the cameras. Councilor Hatcher welcomed the Mayor back and said it was good to have him back. Councilor Hatcher stated that the Parkhill Road residents would like to see their road taken better care of, and he asked if it is on the list for overlay. He added that they would like to see it widened. Public Works Director Russell Schreiber said he will check into it. Councilor Hatcher asked staff to look into the alleyway situation between Tobago and Martinique and between Barbados and Haiti; it is really bad in some areas. He suggested looking at the dumpster placements in the alley as a possible solution. Councilor Hatcher mentioned the Texas Department of Transportation meeting they had attended, noting that it had not been held here in twelve years. He commended everyone at Midwestern State University and everyone involved as well as everyone at the local TXDOT for putting on a great meeting and showing the State Commissioners a good time. It makes Wichita Falls look good. Councilor Hatcher mentioned the Berend's Landing Bridge and stated that the committee working on that is going to do what they can. He asked anyone who has an interest to get in touch with him, Councilor Elmore, Roby Christy or anyone at Streams &Valleys. Councilor Ginnings asked if we have the capacity to fill the elevated tank at Cypress. Public Works Director Schreiber replied that we do once we close some valves out there to basically establish that fourth pressure plane and we think we can fill it on a temporary basis with the existing high service pumps. Councilor Ginnings asked if it had been filled yet and Mr. Schreiber replied that it has not been filled yet. Councilor Ginnings asked for a report on the micro filtration repair project. Mr. Schreiber said it had been moving along pretty well and gave a detailed update. Councilor Ginnings mentioned the memo on graffiti and asked if that was going to come up any time soon. City Manager informed that the memo was for background information and he would like to place it on the next agenda for discussion only; then if Council decides it can be brought back as an ordinance at a following meeting. Councilor Ginnings mentioned elderly persons being threatened by dogs, overfriendly dogs that are let out of neighbor's cars and knock down elderly folks in their yard. He asked if we have an adequate procedure to file a complaint that would bring both parties into a negotiating or judicial situation. For instance, write a ticket then they have to show up and answer complainant. City Attorney stated that we have a vicious dog ordinance, which has criteria that has to be met in order to establish a vicious dog. Health Director Lou Franklin explained that it has to be an aggressive action against someone by the animal, have bitten another animal or a person or chased a person. There are criteria and we do have vicious dog affidavits that if a person feels an animal is acting aggressive towards them and is out, but if the animal is 386 Item 11 b continued Confined, that is not grounds for a vicious dog because that animal is contained at all times. The City Attorney added that we have an investigation process for vicious dogs and an at large ordinance if a dog is not on a leash or confined in the back yard. If the dog is not on a leash inside the car and is let out, it is considered to be at large. Councilor Ginnings explained that he was thinking more about a police investigation situation than animal control because they nearly have to see something happen and it is too late once someone has been seriously injured. It is too bad when you have to wait until after something bad has happened. Councilor Ginnings commented that large numbers of apartment complexes are being built in our City and some are very large, and are experiencing high crime rates. He asked for an opinion for an ordinance to require some law enforcement/trained person or some level of security. He asked if that is something we can pursue. City Attorney stated that would be something for us to look at. It appears to me to have some possibilities, but we can look into that. Councilor Ginnings commented that Chief Bachman is looking at some things in that area that are voluntary, but I am interested in if we need to look at something a little more stringent. He was concerned that in10-15 years from now, in some instances, they will be trashed crime ridden situations. He related a situation he saw in a major city in the Midwest several years ago where many complexes had been built and huge amounts of money spent but were not well taken care of resulting in what his concern is for our City when these complexes are not maintained. Mayor Lyne was glad to be back. He thanked Mayor Pro Tern Elmore and other Councilors who filled in for him at different events while he was gone. Mayor Lyne referred to the TXDOT meeting and thanked our folks who were involved, John Burrus, Bob Sullivan and their staffs. They really came together to make it a success. He told the State Commissioners that what we put on for them was not unusual because that is what Wichita Falls does. When we bring organizations together like Texas Department of Transportation and Midwestern State University we put on an entertaining time and a welcoming place to come. It is not unique just because we had the State TXDOT Commissioners here; it is what we do for everybody who comes into town on a regular basis. They like to come here because they are not treated quite as nicely in other parts of the State because of some of the controversies going on. They enjoy their time here and we welcome them back any time. Mayor Lyne reminded City Manager to begin scheduling the town hall meetings so we can get started on those again. Mayor Lyne stated that he has mixed emotions about the comments made by Councilor Ginnings on the apartment complexes and security because he thinks the property owners should be responsible for that. There may be something we can do to encourage the property owner whether that is by ordinance or influence. They should take care of their customers; whether it is a subsidized housing program or federally owned program. We do not have that problem with federally owned housing because we are involved in it. We do not have those problems but in some areas the property does age and deteriorate and it does make it more difficult. Our job is to protect our citizens. These complexes have density and that creates problems. City Manager reminded Council that within one week they will receive his preliminary budget, and on August 15 after the regular Council meeting they will begin the formal budget hearings. Mayor Lyne mentioned the food Bank drive and City Manager informed that the City is already involved. Mayor stated that this is something that anyone can get involved in. Food will be collected during Hunger Awareness Week, September 19. He commented that the Food Bank does not get their freebies like they used to so we all need to help out. Items 12 and 13a-c City Council went into Executive Session at 10:45 a.m. as authorized by Section 551.072 and Section 551.074 of The Texas Government Code. 387 Items 12 and 13a-c continued City Council reconvened at 11:30 a.m. Mayor announced that no votes or polls were taken during Executive Session. Item 14a Moved by Councilor Elmore to appoint Mr. L.O. Nelson, Alternate 2, Place 11, to Place 2 on the Planning and Zoning Commission with term to expire December 31, 2009; and that Mr. Warren R. Gardner be appointed as Alternate 2, Place 11, with term to expire December 31, 2008. Motion seconded by Councilor Hatcher and carried by the following vote. Ayes: Mayor Lyne, Councilors Barham, Roberts-Bums, Hatcher, Ginnings, and Elmore Nays: None Item 14b Mayor Lyne reappointed Mr. Powell Burns, Place 4, and appointed Mrs. Mary Humphrey, Place 5, to the Housing Authority with terms to expire July 31, 2010. Item 14c Moved by Councilor Elmore to appoint Mr. Glenn Barham to the Wichita-Wilbarger 911 District, Place 1, with term to expire May 5, 2009.
