I. CALLTOORDER
Scott Plowman called the Health Board meeting to order at 12:00 pm after a quorum of members
was anained.
II. APPROVAL OF MINUTES AND ABSENCES
Scott Plowmen called for the review and approval of minutes from the meeting held on Friday April
22, 2016, Diane Stewart introduced a motor to approve the minutes and Dr. Rains seconded the
motion. The motion passed unanimously.
At this time it was noted the excused absence of Dr. Coniston.
III. DOG FRIENDLY PATIOS
Susan Mortis the Environmental Health Administrator said that she received a call that asked N dogs
re allowed on restaurant Patios not being sura it prompted some research that lead to the discovery
that dogs are not allowed on patios.
Current Texas Food EstabLshment Rules prohibit animals on patios as stated below.
§228,185(o) Prohibifirg animals.
1) Except as specified in paragraphs (2) and (3) W this subsection Irve animals may not be
allowed on the phrmlaes ota food establishment.
The definition of premises in the food oduglishment rules means all the property of a restaurant
made and out.
2) Live animals may be allowed in the following situations if the contamination of food, Gear
equipment, utensils, linens and unwrapped single -service and single -use articles cannot
result:
(A) edible fish or decorative fish in educations, shellbah w wosmosis on ice or under
reIn'gerefion,
and shellfish and crostacea in display tank systems,
(B)pairs dogs accompanying police or security officers in omces and dining, sales, and
storage areas, and sentry, dogs running loose in outside fenced areas
(C) in areas that are not used for also preparation and that are usually open for customers,
such as dining and sales areas, service animals in training when accompanied by an
approved trainer if a health or satisfy hazard will not result from Me presence or activities
of the service animal,
Service animals in Texas can only be dogs.
(D) pets in the common dining areas of fnslltu8anal care facill such as nursing homes,
assistant living facilities, group homes or residential care facilities at times other than
causing meals if

linens, and unwrapped singlesarvice and single -use articles cannot result.
Texas Food Establishment Rules allows a whence as stated below.
§228243. Valances
(a)Moolgcatians and waters The regulatory authority may grant a vadancid by modifying or
waiving the requirements of these miss if in the opinion of the regulatory authority a health
hazard or nuisance will not result from the vanence.
A friendly pet permit is going to be allowed for a fee of $125 a year to rn concurrent with an
establishment food permit. The fee was based on the charge for any upgrade to a permit such as
an extra meat market, extra catering permit that requires extra work for the health inspectors. The
establishment will have to comply with the following conditions those that wanted the permR are
satisfied with the conditions.
Rules
Sec 26.524: Compliance Requirements of Dog Friendly Pulp Pumps holders
(a) Pursuant to §228.186(0) of the Texas Food Establishment Rules (TFER) which prohibits
animals an the premises of a two establishment, the Wichita Falls Health District may grant
e dog friendly patio permit to a food establishment in order to allow dogs to be present in the
outdoor patio area of a food establishment The food establishment shall comply with the
following conditions to ensure than a health hazard or nuisance will not result from the
modiFcation or waiver.
A separate entrance must be provident from the outside of the two establishment to the outdoor
patio so that a dog will have direct access to the patio wihout entering the interior of the food
establishment or any playground area of the food establishment. An approved sign shall be posted
at the front entrance&the food establishment so that it is easily visible to the public. Thesign
must state '000 FRIENDLY PATIO: 000 ACCESS TO OUTDOOR PATIO ONLY.- The sign shall
also include 'To most violations, contact Wichita Falls -Wichita County Public Health District at W-
761 -782P.
Doors at all entrances to the outdoor patio from the interior of the food establishment must be
equipped with saN-closing devices and kept closed when not in use
No food preparation may be aedonned in the outdoor patio area, except that a beverage glass may
be filled on the patio from a pitcher or other container that has been filled or otherwise prepared
inside the food establishment.
Hand scooter shall W available to customers add employees in the outdoor patio.
The outdoor patio must be continuously maintained free of visible dog hair, dog dander, and offer
dog -related waste of debris. The outdoor patio mug he cleaned with animal friendly chemicals a
the beginning of each shift during Mich food or beverages will be served. Waste created from a
dogs bodily functions mug be removed and cleaned with animal friendly chemicals immediately
after each occurrence. Appropriate materials for this purpose shall be kept near the designated
outdoor area. All dog waste shall be placed in insect and rodent proof containers located adjacent
to the radio and must be disposed of outside a the food establishment in an approved covered
wage receptacle. Equipment used to dean the outdoor patio must be kept outside of the food
estaglshment.
While on duty, went staff, bus staff, or other food handlers at the food establishment may not pet or
have contact with any dog.
A dog must be kept on a leash and remain in the control of the customer Mile in the outdoor patio
area. The dog must have proof of current mbies vaccination. The dog must also have a current
license issued by the local jurisdiction where the dog resides, The Wichita Falls Animal Services
can be contacted at 8401]61-]824 for information about a City of Wichita Falb tlog license. Any late
or scratch from a dog shall be reported to Animal Services.
Dr. Williamson asked had any specifications been made on the length of the leash that a retractable
leash can shoot out 20 feet.
Susan Morris answered that specifcabons on the leash length could be made that it only states in
control.
Dr. Gibson affirmed the need to have the length of the leash specified she recommends 6 feet
otherwise the dog is going to the next Fade.
Lou Kreidler confirmed an addition of a no retractable leash and a leash cannot be more than 8 feat.
Scott Plowman questioned if it states anything about aggressive dogs fat service dogs have
growled at caskmers.
Kafena Mitchell a" even with service dogs you can ask the customer to leave.
Susan Moms added even with a service dog if the owner is not in central you can tell them to leave
the Americans with Disabilities Act (ADA) for animals in restaurants states that. Other cities with the
patio ordinance had been contacted to inquire of any problems, increase of calls they advised not
really those askbllshments had already allowed it with or without Me ordinance.
A dog is not allowed on a seat, table, countertop, or any other surface that customers use in the
outdoor patio area.
A dog is not allowed to have contact with any dishes or utensils used for food service or preparation
at the kola establishment.
Food establishment personnel may not serve any food to the dog. Kibble, biscuits, and edible treats
may be given to the dog by the customer. Water for dogs shall be provided by the food

establishment in a disposable container.
Susan Monis stated then are so the establishment does not use a dish that a customer would use

is used that the dog drank from there is Me potential to spread diseases. The same reason you do
not want one human drinking after another you do notwant a dog drinking after another.
Dr. Gibson thought it would be hard for the restaurant owner to make sure their employees do not
touch the animals.
Susan Moms mentioned an establishment does not have to have a dog hardly patio. Frank & Joe's
wanted one, came to us, worked hard to do everything by Me book they approached it the coned
way. Other establishments had already been doing it Illegal Be new May will have to comply.
Lou Kne dler stated the establishment must apply to the Health Depsdment W gat an inspection the
same as a restaurant opening to assure everything is in place before a permit would be issued In
the event of violations, problems, increase of Animal Control calls due to net keeping the dogs in
control Me Health Cantonment can suspend the permit mail the issues are under control. The Health
Department can suspend and revoke the permit just like any other permit.
Dr. Williams said it states a permit granted is for one year to am concurrent with the food
establishment permit do they have to wait until they renew their facd permit.
Susan Moms replietl under the fee ordinance it states any fee can be prorated.
Lou KreMler explained if the establishment gets their friendly dog permit with six months into their
food permit then a six month friendly dog was will be issued until the next renewal. The reason for
doing it concurrent is simply easier to track and to know that all are due at the same time. The
health inspector win do all permit inspectors (food establishment, dog patio, soft serve, grease trap,
etc.) at once and not have to go back at different times for each permit inspection. Katrena Mitchell
was asked X she had issues or conceme.
Kahane Mitchell thought it would be a good thing the town has gotten more dog friendly, dog ovmers
more responsible, and dog people want b take their dog places with Mem.
Lou Krel leT asked for a Health Board recommendation on the ordinance to present before the City
Council with Me addition of their recommendation to specify the length of the leash cannot be more
than 6 feat and no retractable leash.
Dr. Williamson introduced a motion to move the ordinance forward to City Council with the Boards
approval. Scott Plowman seconded the motion. The motion passed unanimously.
Zile being in the news Lou Kill confirmed that the Health Department has an active surveillance
program. The vector control staff of Susan Morris goes out to different areas to trap mosquitoes that
are sent to DSHS for species identification in Me area and any disease. The areas first positive
West Nile pool usually comes in the first weak of August none have been recordetl yet but DSHS
runs about trace weeks behind it is generally expected during this time of Me year. In fad of the 700
sent off for testing 000 of those have been the Culex Duircufa dal which Is the mosquito that
causes West Nile those are the most prevalent in our area only 15 of those are the Aedes mosquito
that causes Lka. Low numbers of the Aedes mosquitoes are being caught pad of that maybe due
to having only a couple of the specially designed traps needed to trap these types of mosquitoes.
The Health Department has had one traveler with the fast done the specimens seat off that tested
negative. A Dodoes office sent him to the Health Department with a prescription to test for Zika it
involved to work ark educate the doctor on proper procedure Mat resulted in a good exercise for Me
stag. The epidemiokgist an Susan's team went out to to home of a couple to survey the inside
and outside of day home for breeding sites if the Aedes mosquito Is present it does not have a very
large 8ignt pattern so it probably would have been breeding around the Mme. As in Florida such a
targeted treatment area was done because the mosquito does not fly very far it usually stays within
to area it breeds. The couple was taken a Zika package with mosquito spreY. repellant, condoms,
and educational materials they diff test negative for all, Zika, Dengue, Chlku gunya. It allowed us to
put our teams in place, see how the process was going N work and what was headed to be done
better. It is watched closely not only what s going on across the ha rid but across the word
especially in Texas. Some door hanger materials for now and later have been printed to provide
some education in the case of an event to place out in the community. There are posters available
on simple steps to prevent Zika in most and work ourdoom also flyers about mosquito source
reduction it anyone would like to take some to put in your offices. MSU has many students that
return home to the Zika epidemic countries then return back to school. The Preparedness grant
funs allowed the production of all the informative materials even though no extra funds to data have
been received for Zika.
Dr. Williamson said k would be useful for an instmctlonal message be pairs out locally on testing a
patient for Zika you draw this Noe and send it with this order to this Lab.
Lou Kradter replied that it will be sent directly to him she had asked for it to be sent out and
assumed that d had been done because of the new guidance, new testing requirement and whom
was eligible for testing. One thing is when you have an individual you want to test you have to
consult with DSHS the individual must meet certain requirements for to State to pay for the testing.
An individual can ceRainly go to a private lab but it is very expensive an most insurance do not
cover it so if they meet the DSHS where the test can be done for free trough the State.
The August meeting was moved up because of the need to have the meeting to get the dog issue to
council and make a" changes. The senior data seemed to work better simply because of to
Hotter -n -Hell weekend it maims something to be considered for the August meetings.
