IQk a0 O3 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, ACCEPTING THE MPEC COLISEUM SITE IMPROVEMENTS PROJECT AND AUTHORIZING FINAL PAYMENT TO ELECTRA CONSTRUCTION COMPANY, INCORPORATED; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, on May 5, 2001, the City entered into a construction contract with Electra Construction Company, Incorporated for the MPEC Coliseum Site Improvements Project in the amount of $1,169,926.00; and WHEREAS, change orders in the amount of $512,032.09 were approved for this contract, much of which was due to additional parking lot construction work that was not originally in the contract; and WHEREAS, the total cost for this contract was $1,681,958.09, of which $1,657,670.04 has been paid to the contractor, leaving a remaining balance of $24,288.05; and WHEREAS, the work has been completed satisfactorily and found to be acceptable to the City and the MPEC Board of Directors. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 . The MPEC Coliseum Site Improvements Project is hereby accepted, and the City is authorized to make final payment to the contractor. SECTION 2 . It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 2nd day of September, 2003.
