Ord 32-2009 5/19/2009 • , \ w � ORDINANCE NO. 3a, Ordinance Canvassing The Returns Of The Municipal General Special Election Held In The City Of Wichita Falls, Texas On May 9, 2009. WHEREAS, the City Council of the City of Wichita Falls has heretofore called for a General Special Election to be held in said City on May 9, 2009, to elect a Councilor- At-Large, Councilor District 1, and Councilor District 2; and placing three Propositions on the ballot to amend the City of Wichita Falls Charter; and, WHEREAS, election officers who held said election have duly made the returns of the results thereof, and said returns have been duly delivered to said City Council; and, WHEREAS, it is hereby officially found and determined that the meeting at which this Ordinance was passed was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by the Texas Government Code, and, WHEREAS, after canvassing the returns of said election, it was found to be duly and legally held in all respects, and that 1,081 voters voted in said election, and that votes were cast as follows: COUNCILOR AT LARGE Glenn Barham (Unopposed) received 723 votes. COUNCILOR DISTRICT 1 Michael Smith (Unopposed) received 206 votes. COUNCILOR DISTRICT 2: Dorothy Roberts-Burn (Unopposed) received 57 votes. PROPOSITION 1: City Council Elections to be decided by Plurality Vote Yes 425 votes. No 649 votes. PROPOSITION 2: Appointment of Clerk by City Manager Yes 522 votes. No 547 votes. � � 1 PROPOSITION 3: Unexpired Terms do not apply to Term Limits Yes 768 votes. No 300 votes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. Said election was in all respects legally held in accordance with the laws of the State of Texas and the Charter and the Ordinances of the City of Wichita Falls. 2. The City Council officially finds, determines and declares the results of said election to be that Glenn Barham was duly and legally elected Councilor At Large; that Michael Smith was duly and legally elected Councilor District 1; and that Dorothy Roberts-Burns was duly and legally elected Councilor District 2. 3. The City Council officialfy finds, determines and declares the results of said election to be that Proposition 1 and Proposition 2 failed and that Proposition 3 passed. Said Proposition 3 reads as follows: Proposition 3. Shall Section 12 of the City Charter be amended to provide that a Councilor or Mayor can serve a maximum of three (3) successive two (2) year terms in the same office, provided that the term served in filling a vacancy or unexpired term shall not be considered as part of the three (3) successive terms of two (2) years each? However, in no event shall an elected official of the city be eligible to be elected to more than ten (10) consecutive years (exclusive of unexpired terms) in any combination of elective office.
