Ord 33-2009 5/19/2009 .. . t ` �; ORDINANCE NO. 33^O�O� Ordinance Amending Section 22-27 Of The Code Of Ordinances To Modify Section 106.1 Of The International Building Code To Eliminate The Requirement For ArchitectlEngineer Stamps For Assembly, Educational, And Institutional Occupancies Of Less Than 2,500 Square Feet And Clarify Requirements For Construction Documents To Be Prepared By Engineers or Architects WHEREAS, the City Council finds that plans for buildings with high occupancies should be prepared by engineers or architects (as appropriate) to safeguard occupants. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. The amendment to Section 106.1 of the International Building Code contained in Section 22-27 of the Wichita Falls Code of Ordinances is amended to read as follows: "106.1 Submittal documents. Construction documents, special inspection and structural observation programs and other data shall be submitted in one or more sets with each application for a permit. The construction documents shall contain the seal of a Texas-licensed engineer or Texas-licensed architect, where the following conditions exist: 1. All Group A(Assembly), E(Education) and I(Institutional) occupancies of 2,500 square feet or more in area. 2. Buildings and structures three stories or more high. 3. Buildings and structures 5,000 square feet or more in area. For all other buildings and structures, the submittal shall bear the certification of the applicant that some specific state law exception permits its preparation by a person not so registered. If the Building Official determines the preparation of the construction documents necessitates the "practice of engineering" as provided by the Texas Occupations Code, then the construction documents or the part thereof that constitutes the "practice of engineering" must be sealed by a Texas-licensed engineer. EXCEPTION: Group R3 buildings, regardless of size, shall require neither a registered architect or engineer, nor a certification that an architect or engineer is not required." f��, hr� PASSED AND APPROVED this the 19th day of May, 2009.
