Ordinance Of The City Council Of The City Of Wichita Falls, Texas,
Abandoning And Transferring Maintenance Responsibilities For A
Public Sewer Easement At The Sam Houston Elementary School Site
To The Wichita Falls Independent School District
WHEREAS, abandoning a public sewer easement relinquishes the City of all
maintenance and repair responsibilities with respect to the owner of the property served
thereby; and,
WHEREAS, the Wichita Falls Independent School District (WFISD) apparently
owns the property in the area described herein and is requesting abandonment to assist it
in expanding Sam Houston Elementary School; and,
WHEREAS, the WFISD has agreed to accept all maintenance responsibilities in the
area to be abandoned by the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
Subject to the WFISD's agreement to accept all maintenance responsibilities in the
area to be abandoned, the sanitary sewer easement described in the attached Easement
Abandonment is abandoned. The City Manager may execute all documents necessary to
memorialize this abandonment and transfer maintenance responsibilities in the
aforementioned area to the WFISD, in a form to be approved by the City Attorney.

A portion of a utility easement in Wichita County, Texas, as dedicated on that plat of Lot 1, Block
59B, Highland Addition, an addition to the City of Wichita Falls as recorded in Volume 28, Pages
432 and 433, Wichita County Plant Records and being more specifically described by metes and
bounds as follows:
Commencing from a'/2 inch iron rod at the intersection of the south right-of-way line of Miami
Street and the east right-of-way line of GarField Street for the northwest corner of said Lot 1, Block
59B;
Thence along the east right-of-way line of Garfield Street and the west line of said Lot 1, Block
59B, South 00°28'46" West 154.00 feet to a point for the most westerly northwest corner and Place
of Beginning of this description;
Thence South 89°32'35" East 422.12 feet to a point for an interior corner of this description;
Thence North 154.45 feet to a point in the south right-of-way line of Miami Street for the most
northerly northwest corner of this description;
Thence along the south right-of-way line of Miami Street, South 89°36'22" East 6.14 feet to a point
for the most northerly northeast corner of this description;
Thence leaving the south right-of-way line of Miami Street, South 25°39'53" East 20.46 feet to a
point for the most easterly northeast corner of this description;
Thence South 151.09 feet to a point for the southeast corner of this description;
Thence North 89°32'35" West 437.24 feet to a point in the east right-of-way line of Garfield Street
and in the west line of said Lot 1, Block 59B for the southwest corner of this description;
Thence along the east right-of-way line of Garfield Street, North 00°28'46" East 15.00 feet to the
Place of Beginning and containing 0.202 acre of land (8,793 square feet), more or less.
