I YA - 50 03 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING THE LUCY PARK LOG CABIN RENTAL AGREEMENT, FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, a recent rental experience has indicated a need for the Log Cabin Rental Agreement rules to be amended to more clearly permit the City to retain a portion of the damage /cleanup deposit as a penalty should a renter enter the Log Cabin before the rental period. and, WHEREAS, grammatical improvements are also proposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 . The Log Cabin Rental Agreement rules are hereby amended as per the attached Rental Agreement. SECTION 2 . It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. MAYOR ATTEST: r City Clerk 1 City of Wichita Falls Parks and Recreation Department Log Cabin Rental Agreement The Log Cabin may be reserved up to six months in advance and is available for rent seven days a week from 6 :00 a.m. until 11:00 p.m. Use of the Log Cabin is restricted to the reserved rental block of time and any other use, other than pre- rental inspection, is trespass of public property. Renting the Log Cabin is arranged in person, at the Recreation office, located at 10th and Indiana, second floor in room 209. No phone reservations shall be accepted. The Parks and Recreation Department has the right to prohibit use of the Log Cabin to previous policy offenders. Renter must be an adult (18 or over) and a resident of the City of Wichita Falls. Rental blocks of time are as follows: 1st rental block 6:00 a.m. -10:00 a.m. _ $40.00 2nd rental block 10:00 a.m. - 2:00 p.m. _ $40.00 3rd rental block 2:00 p.m. - 6:00 p.m. _ $40.00 4th rental block 6:00 p.m. -11:00 p.m. _ $50.00 The City of Wichita Falls is hereby exempt from any fee and deposit requirements set out under this rental agreement. 3. Rental Fee and Deposits are prepaid Deposits for cleaning ($100) and keys ($15) are paid along with the rental fee before the Log Cabin is reserved. Cash, check, cashier's check, money order, Visa or Mastercard are accepted. Reservations made two weeks or less before the date shall be paid with cash, money order, cashier's check or credit card, but not by check. 4. A maximum of fifty -five (55) persons may be present within the Log Cabin. 5. There are 6 tables (measuring 8' x 30" each) and 55 chairs stocked in the Log Cabin. The kitchen contains a sink and large counter top work area, but, no refrigerator, stove, or dishwasher. 6. Events or parties for youths (17 and under) must be chaperoned by a minimum of one adult per fifteen youths. Keys shall be picked up at the Parks & Recreation Office, Room 209, 10th and Indiana. Renters shall obtain keys for weekday reservations on the day prior to the scheduled reservation. Renters shall obtain keys for Saturday and Sunday reservations on the previous Friday between 1:00 to S:OOp.m. If renter fails to pick up keys before office is closed, then the keys must be picked up at the Wichita Falls Police Department, 610 Holliday at Seventh Street, (Phone #761 - 7611). The renter must present their rental receipt in order to obtain keys from the Wichita Falls Police Department. A $30 penalty shall be retained from the renter's damage /cleanup deposit. Keys shall then be returned to the Parks and Recreation office. Keys must be returned the next workday following the event or forfeit the key deposit. 8. No sales will be permitted within the park or Log Cabin area. 9. Alcoholic beverages are permitted within the fenced Log Cabin premises only. Renter must ensure guests comply with all State regulations for alcoholic beverages. 10. Decorations may not be affixcd to any portion of the Log Cabin except by securing with string or tape. All decorations, including string and tape, must be completely removed after each rental period. No tacks, nails or duct tape. 11. Report immediately any problems with heating /cooling units, water heater, restroom malfunctions, etc., to the Park Maintenance office, 761 -7491. After 5:00 p.m. and weekends, call the Police Department, 761 -7611. No attempt is to be made by renter to repair any of the above items. 12. Clean -up requirements of Renters include: • Clean tables and chairs and re- stack. • Clean up all decorations, paper goods, food, bottles, cans, and other debris and deposit in the trash barrel located in the parking lot. This includes the outside perimeter of the Log Cabin . • Floors are to be swept and mopped in an acceptable manner. • Leave the Log Cabin litter container empty. Clean and replace plastic liner from supplies stored in lower kitchen cabinet. The mop and broom are stored in the kitchen area. Cleaning products (multi purpose cleaner, abrasive chlorine and trash liners) are stored in a lower kitchen cabinet. In the event there is a shortage or if you use all of a product, please report this information at the time the key is returned. 13. When leaving the Log Cabin turn off all lights and the air conditioner control. Set heater thermostat to 50° in winter. Renter is responsible for ensuring the Log Cabin windows, doors, and the fence gates are locked before leaving the premises. 14. The Parks and Recreation Department staff or other designated City employee may inspect a function at any time evidence is received the property is being damaged or policies violated. If Renter is advised to cease such behavior and continues such, the Renter may be instructed to immediately vacate the Log Cabin. 15. The key and building deposits will be returned within ten working days after keys are returned and no damage or unclean conditions are reported. Entering the Log Cabin before the rental block or staying after the rental block is trespass of public property and an amount of the damage /clean -up deposit equal to the block of reservation time during which the renter trespassed shall be retained as a penalty. Should damage, clean up, or the penalty for trespassing the premises exceed the deposit, the Renter will be billed for the additional costs. Payment is due immediately upon receipt. 16. Refunds on cancellations are available only if the Renter notifies the Parks and Recreation Department office in writing at 600 11th Street Room 209 Wichita Falls Texas 76301 facsimile a 767 -1090, or E -mail at clint strongAcwftx net two weeks or more prior to the rental date. A cancellation charge of $25 will be retained from the rental fee. The Renter will receive the balance of the rental fee and deposits by mail within ten working days of the notification. "There is no refund of rental fee if notice is received within two weeks of rental date.
