RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE A
QUITCLAIM DEED TO MIDWESTERN STATE UNIVERSITY FOR A 70'
X 210' TRACT OUT OF EUREKA PLAZA ADDITION TO THE CITY OF
WICHITA FALLS; FINDING AND DETERMINING THAT THE MEETING
AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, by instrument dated November 1, 1975, filed in Volume 1187, Page
527 of the Wichita County Deed Records, the Eureka Life Insurance Company of
America dedicated a 70' x 210' tract of land for a public park; and
WHEREAS, the City of Wichita Falls has never accepted or maintained the 70' x
210' tract of land; and
WHEREAS, it is the desire of Midwestern State University to acquire such
property and use it for proper public purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . The City Manager is hereby authorized to execute the attached
Quitclaim Deed to Midwestern State University.
SECTION 2 . It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF WICHITA §
THAT the City of Wichita Falls, Texas, a municipal corporation, hereinafter called
Grantor, acting by and through its duly authorized City Manager, for and in
consideration of the sum of Ten and No /100 ($10.00) Dollars and other good and
valuable consideration, in hand paid by Midwestern State University, hereinafter called
Grantee, the receipt of which is hereby acknowledged, has granted, sold, conveyed,
released, and forever quitclaims unto the said Grantee, all its right, title, and interest in
and to the following described real property situated in Wichita County, Texas, to -wit:
A 70' x 210' tract of land out of the Eureka Plaza Addition to
the City of Wichita Falls, as identified in the final plat of
Eureka Plaza, recorded in Volume , Page
Plat Records of Wichita County, Texas, said 70' x 210' tract
being further identified in the map attached and incorporated
herein as Exhibit A.
TO HAVE AND TO HOLD the above - described premises, together with all and
singular the appurtenances thereto, except as otherwise reserved, in any way belonging
unto the said Grantees, their heirs and assigns, as above provided.
IN WITNESS WHEREOF, the City of Wichita Falls, Texas, a municipal
corporation of Wichita County, Texas, has caused this instrument to be executed by its
City Manager this the day of November, 2003-
