RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, ACCEPTING THE 2003 CDBG STREET
REHABILITATION PROJECT AND AUTHORIZING FINAL PAYMENT TO
FREEMAN CONSTRUCTION CO.; FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit price contract with Freeman
Construction Co. with the estimated total cost of $492,442.00; and,
WHEREAS, after liquidated damages are assessed, the actual work was
completed at a total cost of $329,071.62, of which $319,336.20 has been previously
paid to the contractor, leaving an amount due of $9,735.42; and,
WHEREAS, the City staff has inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . The 2003 CDBG Street Rehabilitation Project is hereby accepted,
and the City Manager is authorized to make final payment to the contractor.
SECTION 2 . It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
