Res 015-2003 2/18/2003RESOLUTION NO. lf�-X 3 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE NORTH CENTRAL TEXAS OFFICIALS ASSOCIATION FOR OFFICIATING SERVICES FOR THE CITY'S AMATEUR ATHLETIC PROGRAM; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, on February 5, 2003, the City received bids for the officiating services for the City's athletic program, and WHEREAS, the North Central Texas Officials Association is the lowest responsible bidder for the services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 . The City Manager is hereby authorized to execute an agreement with the North Central Texas Officials Association for officiating services. A copy of the agreement is attached hereto and made a part hereof for all purposes. SECTION 2 . It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 18th day of February, 2003. l� , ATTEST: V h City Clerk CITY OF WICHITA FALLS PARKS AND RECREATION DEPARTMENT AGREEMENT FOR OFFICIATING SERVICES This agreement, made and entered into by and between the City of Wichita Falls, a municipal corporation of the County of Wichita, State of Texas, hereinafter referred to as the City and the North Central Texas Officials Association, hereinafter called Association. WITNESSETH: For and inconsideration of the mutual covenants herein, the parties hereto do hereby agree as follows: Agreement Term. This agreement shall be for a one -year period beginning March 1, 2003, and may be renewed by the City for two successive one -year periods. Any renewal shall be under the same terms and conditions as the first year agreement. Individual Termination. In the event the Program Coordinator determines the work performance of an official is not satisfactory, the Program Coordinator shall notify the President of the Association, and such official shall not be used by the Association for any further work required by this agreement. Agreement Termination. The City of Wichita Falls reserves the right to terminate the agreement immediately in the event the Association fails to provide required qualified officials per the game schedules, or otherwise perform in accordance with the agreement. The agreement may be terminated by the City upon written notice to the Association, deposited as certified mail at least 15 days prior to the termination date. This written notice shall state the reasons for termination. Association shall be allowed 10 calendar days from the date the written notice was mailed, to remedy the conditions outlined in the notice to the City's satisfaction. In the event of termination, the City's liability for payments to Association will be limited to making payments for agreed upon services up to the termination date. City Responsibility. The City shall have a Program Coordinator to supervise the administration of this contract. The Program Coordinator shall notify the association of all scheduled activities and any special requirements. i.e. league, regional and state tournament playoffs. The City shall pay the Association for services rendered, at the agreed upon price. The Program Coordinator or his authorized agent shall verify such services. The Program Coordinator shall conduct training sessions on: A. City rules pertaining to the sport being officiated and the filing of required incident reports. B. Ground rules that are a permanent part of the playing areas. C. Policies, procedures and rules pertaining to facilities used for City sports activities, but not owned by the City. Schedule Changes. Officials and scorekeepers may receive verbal notification of games changes and forfeits prior to game time from the Program Coordinator, the Recreation General Services Superintendent, the Customer Service Attendants or the Parks and Recreation Information Line. Game officials and scorekeepers will not receive any pay for forfeited games when prior notification has been made. It will be the responsibility of the Associations' designee to pick up and sign for all rainout schedules. Payment. The City shall pay the submission of statements to the Parks rendered the previous two weeks. Association on a bi- weekly basis upon and Recreation Department for services Association Responsibility. The Association shall furnish officials and scorekeepers for basketball, softball, flag football and volleyball games for the City's Recreation Division during the term of the agreement, and shall be required to have the following number of officials and scorekeepers for each league game. Softball 1 1 Flag Football 3 0 Co -ed Volleyball 1 0 SOFTBALL: The Association must maintain a minimum of 21 active softball umpires and 12 active softball scorekeepers throughout each softball season. Of these 21 umpires 10 must have a minimum of 4 years experience. Of the scorekeepers 5 should have a minimum of 3 years experience. All umpires and scorekeepers must be currently registered with a national organization such as ASA or USSSA. In addition to their national certification each member with less than 2 years experience must complete 12 hour of training prior to officiating their first game. The training should consist of 6 hours of field training and 6 hours of rulebook training. BASKETBALL: The Association must maintain a minimum of 10 active basketball officials and 6 active scorekeepers throughout the entire basketball season. Any of these officials with less than 2 years experience must complete 10 hours of training prior to officiating their first game. FLAG FOOTBALL: The Association should maintain a minimum of 6 active flag football officials throughout the entire football season. All of these officials should complete 6 hours of training prior to officiating their first game. It will be the responsibility of the Association to maintain a log of all completed training for all trained officials in all sports. This log should be available to the City upon request. The Association shall consist of a minimum of 3 board members. This board is responsible for establishing and compliance with the by -laws of the Association. The Association will also be responsible for scheduling officials for all scheduled games. The Association should provide a standard dress code for all members of the Association. Uniforms should resemble basic attire used by national amateur athletic organizations. In addition, the Association shall, upon notification by the Program Coordinator, furnish adequate officials and scorekeepers for designated games in league, regional and state tournament playoffs. The Association shall enforce all rules of the Parks and Recreation Department for league and playoff games as well as the current playing rules for the sport being officiated. The Association is responsible for conducting training sessions for officials as listed, and providing rulebooks. A. Rule interpretations /current year rule changes. B. Mechanics C. Uniform dress and appearance. Agreement Amendment. This agreement may be amended by mutual agreement for additional officiating services of sports that are organized for league play during the time of this agreement. Hold Harmless. The Association agrees to indemnify, hold harmless and defend the City, its officials and employees from and against any and all claims for damages or injuries to persons or property arising out of or in any way related to the Associations actions or performance of this agreement. Venue. This agreement is performable is Wichita County Texas, which shall be the exclusive venue for all legal proceedings to interpret or enforce this agreement.
