Ordinance Amending Appendix B Of The Code Of Ordinances To
Add Section 3811 Thereto, Which Will Establish Commercial
Business Closure Times In The Central Business District
WHEREAS, businesses open to the public from 2:15 a.m. to 5:30 a.m. create
unacceptable noise, trash, and traffic disturbances for the residents of the Central
Business District, and intoxicated persons tend to congregate at the establishments
open during this time, causing additional disturbances; and
WHEREAS, requiring the closure of the businesses in the Central Business
District from the hours of 2:15 a.m. to 5:30 a.m. is a reasonable restriction to reduce the
evils accumulated from congregation of persons at and near businesses in the Central
Business District; and
WHEREAS, the need to shelter travelers and ensure continuous provision of
essentials outweighs the need to require closure of lodging establishments and retail
trade businesses at night; therefore, they will be excluded from this closure requirement.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
Appendix B of the Wichita Falls Code of Ordinances is amended by adding
Section 3811, thereto, which shall read as follows:
"Sec. 3811. Special Conditions
The following special conditions are applicable to the Central Business District.
1. Commercial uses shall not be open to the public from the hours of 2:15
a.m. through 5:30 a.m., with the exception of the following:
a. Lodging establishments, as defined by Section 58-201 of this Code,
and
b. Businesses that engage primarily in Retail Trade, as defined by
Section 2030 of this Code."
