Ordinance Closing, Abandoning, And Vacating Melvina Street, Which
Consists Of A 30 Foot Right-Of-Way That Is Approximately 510 Feet
Long Beginning At The East Right-Of-Way Line Of Holliday Road And
Continuing East To Holliday Creek
WHEREAS, the adjacent property owners to Melvina Street, a partially paved
510 foot by 30 foot right-of-way containing approximately 15,300 square feet, have
requested the City close, vacate and abandon said street and,
WHEREAS, all affected utility companies and City departments have reviewed
this request and have recommended conditional approval of this closure with the
retention of a utility easement for a 36-inch sanitary sewer line; and
WHEREAS, it has been determined to be in the best public interest to close,
vacate, and abandon said street as herein indicated on the attached Exhibit "A."
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. Subject to the re-plat noted below, the approximately 510 foot by 30 foot
(15,300 square feet) Melvina Street located at the East right-of-way line of Holliday
Road as indicated on the attached Exhibit "A," is hereby closed, abandoned, and
vacated.
2. Subject to the re-plat noted below, in consideration of the receipt of $2,215.00
for the cost of the property and $250.00 for the cost of the appraisal, the City Manager
is authorized to execute all documents necessary to indicate the City's abandonment of
this property, including a quitclaim deed. The aforementioned utility easement shall be
retained in the property and noted in said documents.
3. This abandonment is subject to the property owner(s) of the underlying and
adjacent property filing an approved re-plat of the property in the records of the Wichita
County Clerk within 6 months from the date of the approval hereof. This ordinance shall
be void and have no effect if said re-plat is not approved and filed within the stipulated
time period.
