J� OJ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING THE RENTAL AGREEMENT FOR THE LOG CABIN AT LUCY PARK, AND REPEALING RESOLUTION NOS. 114 -93, 204 -95, 29 -2000 and 62 -2001; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the Log Cabin at Lucy Park continues to be a popular rental facility for the citizens of Wichita Falls; and, WHEREAS, the repeal of certain resolutions by this resolution's adoption will allow for all the various rules and regulations concerning the Log Cabin to be maintained in one policy. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 . The attached amended rental agreement for the Log Cabin at Lucy Park is hereby adopted. SECTIO 2. This resolution shall supersede all resolutions in conflict therewith, namely, Resolution Nos. 114 -93, 204 -95, 29 -2000 and 62 -2001, and they are hereby repealed. SECTION 3 . It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 4` day of March, 2003. MAYOR ATTEST: t e ity Clerk City of Wichita Falls Parks and Recreation Department Log Cabin Rental Agreement 1. The log cabin may be reserved up to six months in advance and is available for rent seven days a week from 6:00 a.m. until 11:00 p.m. The cabin may not be opened - prior to tale reserved rental time. It must be cleaned and vacated by the end of the reserved rental time. Any other use, other than pre- rental inspection, is trespass of public property. 2. Renting the log cabin is arranged in person, at the Recreation office, located at 10°i and Indiana, second floor in room 209. No phone reservations shall be accepted. The Parks and Recreation Department has the right to prohibit use of the Cabin to previous policy offenders. Renter must be an adult (18 or over) and a resident of the City of Wichita Falls. Times are as follows: I" rental time 6:00 a.m. -10:00 a.m. _,$40.00 21" rental time 10:00 a.m. - 2:00 p.m. _ $40.00 31�J rental time 2:00 p.m. - 6:00 p.m. _ $40.00 41 rental time 6:00 p.m. -11:00 p.m. _ $50.00 The City of Wichita Falls is hereby exempt from any fee and deposit requirements set out under this rental agreement. 3. Rental Fee and Deposits are prepaid. Deposits for cleaning ($100) and kevs (,$15) are paid along with the rental fee before the cabin is reserved. Cash, check, cashier's check, money order, Visa or Mastercard are accepted. Reservations made two weeks or less before the date shall be paid with cash, money order, cashier's check or credit card, but not by check. 4. A maximum of fifty -five (55) persons may be present within the cabin. S. There are 5 tables (measuring 8'x 30" each) and 55 chairs stocked in the log cabin. The kitchen contains a sink and large counter top work area, but, no refrigerator, stove, or dishwasher. 6. Events or parties for youths (17 and under) must be chaperoned by a minimum of one adult per fifteen youths. 7. Keys shall be picked up at the Parks &, Recreation Office, Room 209, 10th and Indiana. Renters shall obtain keys for weekday reservations on the day prior to the scheduled reservation. Renters shall obtain keys for Saturday and Sunday reservations on the previous Friday between 1:00 to 5:OOp.m. if renter fails to pick up keys before office is closed, then the keys must be picked up at the police deparhnent, 610 Holliday at Seventh Street, (Phone #761- 7617). The renter must present their rental receipt in order to obtain keys form the Wichita Falls Police Department. Keys shall then be returned to the Parks and Recreation office. A $30 portion of the renter's damage /cleanup deposit shall be retained. Ke_vs must be returned the next workday following the event or forfeit the key deposit. 8. No sales will be permitted within the park or Log Cabin area. 9. Alcoholic beverages are permitted within the fenced Log Cabin premises only. Renter must ensure guests comply with all state regulations for alcoholic beverages. 10. Decorations may not be affixed to any portion of the cabin except by securing with string or tape. All decorations, including string and tape, must be completely removed after each rental period. No tacks, nails or duct tape. 11. Report immediately any problems with heating cooling units, water heater, restroom malfunctions, etc., to the park maintenance office. 761 -7491. After 5:00 p.m. and weekends, call the Police Department, 761-7611. No attempt is to be made by renter to repair any of the above iteins. 12. Clean -up requirements of renters include: • Clean tables and chairs and re- stack. • Clean up all decorations, paper goods, food, bottles, cans, and other debris and deposit in the trash barrel located in the parking lot. 'fill',' includes the outside perimeter of the cabin. • Floors are to be swept and mopped in an acceptable manner. • Leave the log cabin litter container empty. Clean and replace plastic liner from supplies stored in lower kitchen cabinet. The mop and broom are stored in the kitchen area. Cleaning products (multi purpose cleaner, abrasive chlorine and trash liners) are stored in a lower kitchen cabinet. In the event there is a shortage or if you use all of a product please report this information at the tine the key is returned. 13. When leaving the log cabin turn off all lights and the air conditioner control. Set heater thermostat to 50° in winter. Renter is responsible for ensuring the log cabin windows, doors, and the fence gales are locked before leaving the premises. 14. If Renter is advised to cease such behavior and continues such, the Renter may be instructed to immediately vacate Log Cabin. 15. The kev and building deposits will be returned within ten working days after keys are returned and no damage or uncleared conditions are reported. If the renter fails to vacate the Cabin at the end of the scheduled reservation time, an amount of the damage/clean-Up deposit equal to the next block of reservation time shall be retained as a penalty. Should damage, clean up, ce the penalty for not timety vacating the premises exceeds th<r deposit the renter v��ill be billed for the additional costs. Payment is due innmcdiately upon receipt.. 16. The renter will receive the balance of the rental fee and deposits by mail within ten working days of the notification. There is no refund of rental fee if notice is received within two weeks of rental date.
