RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AUTHORIZING AN AMENDMENT TO THE SKYBOX
CONSTRUCTION AGREEMENT AS PART OF THE COLISEUM
CONSTRUCTION PROJECT; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, on October 10, 2001, the City entered into an agreement with the
MPEC Corporation and Electra Construction Company for the construction of skyboxes
at the Coliseum; and
WHEREAS, during the construction of the skyboxes, there was a need to modify
the design of the facility to change the location of the elevator; and
WHEREAS, this change resulted in an increase to the total construction cost for
the skyboxes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
4 ECTION 1 . Section 1 of the agreement entered into by the City for construction
of the skyboxes at the coliseum is hereby amended in its entirety as follows:
"ECC agrees to construct ten skyboxes in accordance with plans and
specifications included as part of the contract with the City, said contract already
providing for the construction of the Coliseum. Said skybox project will have a price of
One Million, Fifty -Nine Thousand, Nine Hundred Fifty -Two and 27/100 Dollars
($1,059,952.27)."
S ECTION 2. The City Manager is hereby authorized to execute the necessary
legal documents for this amendment to the contract.
; SECTION 3 . It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
