B RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING AN AGREEMENT WITH HABITAT FOR HUMANITY OF WICHITA FALLS TO FACILITATE THE CONDITIONS FOR THE TRANSFER OF CITY -OWNED PROPERTY AT 803 WOODS AND 1002 WOODS STREET, ALSO KNOWN AS LOT 12, BLOCK 5, HOMEWOOD HEIGHTS, WICHITA COUNTY, WICHITA FALLS, TEXAS, FOR THE CONSTRUCTION OF NEW HOUSING, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE SPECIAL WARRANTY DEEDS TO TRANSFER TITLE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, in accordance with Chapter 272.001 of the TEXAS LOCAL GOVERNMENT CODE, the City of Wichita Falls may convey property without the solicitation of bids, to non - profit entities for economic development programs authorized by Title 1 of the Housing and Community Development Act; and WHEREAS, Habitat for Humanity of Wichita Falls desires to continue to construct homes on the Eastside of Wichita Falls for the benefit of qualified low -to -mode rate - income families: and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 . The City Manager is hereby authorized to execute the attached special warranty deed to convey title on the following properties located in Wichita Falls, Wichita County, Texas to Habitat for Humanity of Wichita Falls. 8 Woods: Lot, 21, Block 5, Homewood Heights 1002 Woods: Lot, 11, Block 3, Blackmon & Williams 2 SECTION 2 . It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 15 day of July, 2003. Lot 11, Block 3, Blackmon and Williams 2, also known as 1002 Woods, an addition to the City of Wichita Falls, Wichita County, Texas, as more particularly described in a deed recorded in Volume 898 at Page 427 of the Deed Records of Wichita County, Texas. Reservations From and Exceptions to Conveyance and Warranty: This conveyance is subject to all valid restrictions, covenants, conditions, rights -of -way, easements and other reservations filed of record, if any, affecting the above - described property. In the event Grantee shall fail to comply with the terms of this conveyance, all right, title and interest in and to said property shall, without necessity for suit hereunder shall be null and void, and Grantor shall be entitled to immediate possession of such premises. Grantor, for the consideration, receipt of which is acknowledged, and subjcct to the reservations from and exceptions to conveyance and warranty, grants, sells and conveys to Grantee the property, together with all and singular the rights and appurtenances thereto in any wise belonging, to have and hold it to Grantee, Grantee's heirs, executor, administrators, successors or assigns forever. Grantor binds Grantor and Grantor's heirs, executors, administrators and successors to warrant and forever defend all and singular the property to Grantee and Grantee's heirs, executors, administrators, successors and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof, except as to the reservations from and exceptions to conveyance and warranty, when the claim is by, through or under, Grantor, but not otherwise.
