RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AMENDMENT TO THE LEASE AGREEMENT WITH THE WICHITA
FALLS ARTS COUNCIL FOR THE PROPERTY AT 1300 LAMAR
STREET; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, on December 31, 1998, the City of Wichita Falls and the Arts
Council, Wichita Falls Area, Inc., entered into a 50 -year lease agreement for the
property formerly known as the Kemp Public Library located at 1300 Lamar Street; and,
WHEREAS, it is the desire of both parties to amend the lease agreement to
grant the City an annual option to terminate the lease upon sixty (60) days' written
notice.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City Manager is hereby authorized to execute the attached
Lease Amendment No. 1 to the lease agreement between the City and the Arts
Council, Wichita Falls Area, Inc.
SECTION 2. It is officially found and determined that the meeting at which this
resolution was passed was open to the public as required by law.

THIS AMENDMENT NO. 1 TO LEASE AGREEMENT is made and entered by
and between the City of Wichita Falls ( "Landlord ") and the Arts Council, Wichita Falls

Lease: dated December 31, 1998
The Lease is hereby amended so as to provide that Landlord is granted an
annual option to terminate the term of the Lease upon written notice delivered to Tenant
at least sixty (60) days prior to the then current year term of the Lease. Such
termination may be made without cause and without penalty. In the absence of such
notice, the lease term shall continue for the following year.
The Effective Date of this Amendment to Lease is 200
