Ordinance Of The City Council Of The City Of Wichita Falls, Texas,
Amending Section 82-59 Of The Code Of Ordinances Of The City Of
Wichita Falls To Specify That Mining Or Drilling For Oil, Gas Or Other
Minerals Is Prohibited On The Surface Of Public Parks In The City
And Providing A Penalty In An Amount Of Up To $500 Upon Violation
WHEREAS, the City has submitted in July 2009 a grant application to the Texas
Parks & Wildlife Department for a trail and other amenities in the 80 acre Wichita Bluffs
Open Space site, and a condition of that grant is that oil or gas drilling is prohibited in
City parks, and
WHEREAS, City Staff has previously opined that such prohibition was contained
in Section 82-59 of the City Code, but the Texas Parks & Wildlife Department desires a
specific prohibition on oil & gas drilling as a condition of grant issuance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
Section 82-59 of the Code of Ordinances of the City of Wichita Falls is hereby
amended to read as follows:
"Sec. 82-59. Injuring Property.
It shall be unlawful for any person to remove, destroy, mutilate or deface any
structure, monument, statue, vase, fountain, wall, fence, railing, vehicle, bench,
tree, shrub, fern, plant, flower or other property in any public park or playground.
It shall further be unlawful to mine or drill for oil, gas or other minerals on the
surFace of any public park in the City."
2. Violations of this ordinance shall be punishable by a penalty of up to $500 and
as provided by Section 1-14 of the Wichita Falls Code of Ordinances."
