I. CALL TO ORDER
The meeting was called to order by Chairperson, Mr. Rodney Martin, at 2:00 p.m. Chairperson
Martin proceeded to make the following comments:
a. This meeting is being televised live on Channel 11. It will be replayed at 2:00 p.m.
daily including Saturday and Sunday until the next live meeting is aired which will be the second
Wednesday of next month at 2:00 p.m.
b. Motions made by the Commission members include all staff recommendations and
developmental requirements listed in the staff report. Any deviations will be discussed on a
case-by-case basis and voted on accordingly.
c. Applicants and citizens who wish to address the Commission or answer questions
from the Commission members are asked to please speak into the microphone at the podium.

d. Please silence all cell phone ringers during the meeting. If it is necessary for you to

No one from the audience wished to address the Commission.
Ill. APPROVAL OF MINUTES
Mr. Rick Graham introduced a motion to approve the minutes of the July 13, 2016 meeting.
Mrs. Cayce Wendeborn seconded the motion. The minutes were approved with a unanimous
vote.
IV. CONSENT AGENDA
There were no items on the consent agenda.
V. REGULAR AGENDA
1. Case C 16-13
Request for a conditional use at 1213 & 1215 North 10th Street to allow a
manufactured home in a Residential Mixed Use (RMU) zoning district.
Mrs. Cayce Wendeborn made a motion to approve. Ms. Krystal James seconded.
Mr. Christopher Guess presented the application for a conditional use to allow a
manufactured home in a Residential Mixed Use (RMU) zoning district. He stated the
properties were currently City of Wichita Falls trustee lots. Staff notified 22 surrounding
property owners and received 1 response in favor, 0 in opposition, and 0 with no
opinion/undecided. There were also no responses received from outside the notification
area.
Mr. Guess stated the applicant proposed to replat the two lots in the RMU zoning district
into one lot and place a 1,568 sq. ft. manufactured home on the property. The
dimensions of the proposed manufactured home were 28 ft. by 56 ft. He stated that
when the property is replatted it will be approximately 100 ft. wide and the home would
be located approximately 32 ft. from the front property line and meet the required side
setbacks of 5 ft. The development will be considered as infill and, as such, will be
subject to the requirements of section 5600 (Manufactured Housing as In -Fill
Development) of the zoning ordinance.
Mr. Guess stated staff recommended approval of the conditional use on the stipulation
that the applicant first acquire the property from the City of Wichita Falls, then have the
two properties platted as one, and adhere to the regulations of section 5600 of the
zoning ordinance as outlined in the staff report. Mr. Guess stated that Mrs. Pat
Hoffman, Property Administrator, was in the audience to address any questions
regarding City of Wichita Falls trustee properties.

Chairperson Martin asked if the applicant was in attendance and wished to speak, and
there was no one present to represent the case. Chairperson Martin asked if there was
anyone else in the audience who wished to speak, and there were none.
Chairperson Martin opened the motion to discussion among the commission, there was
no discussion. The motion was taken to a vote and carried unanimously.
2. Case C16-15
Request for a Conditional Use at 4629 Harbor Road to allow a carport in the
required front and exterior side setback within the sight visibility triangle in a
Single -Family 2 Residential (SF -2) zoning district.
Mr. Rick Graham made a motion to approve. Mrs. Cayce Wendeborn seconded.
Mrs. Karen Gagn6 provided an update on the discussion and review of case C 16-15 as
presented at the July meeting of the Planning and Zoning Commission. She stated staff
had contacted the applicant, Mrs. Roddy, to explain that, due to concerns with the
proposed location of the carport at 4629 Harbor Road, the commission had chosen to
table the case to the August 10th meeting, allowing the applicant an opportunity to
propose an agreeable alternative that would remove the carport from the sight visibility
triangle. Mrs. Gagne stated Mrs. Roddy had informed staff she wished to withdraw the
application at this time. Mrs. Gagne stated staff had explained to Mrs. Roddy that in
order to have the application officially withdrawn, it would need to be provided in writing.
Mrs. Gagne stated staff had not yet received a written confirmation of the applicant's
wish to withdraw the application. She stated that, because the proposed location of the
carport was within the sight visibility triangle and would be in violation of the code of
ordinances as outlined by the City Council, staff had no alternative but to recommend
denial of the application as submitted.
Chairperson Martin asked if the applicant was in attendance and wished to speak, and
there was no one present to represent the case. Chairperson Martin asked if there was
anyone else in the audience who wished to speak, and there were none.
Chairperson Martin opened the motion to discussion among the commission. Mr. Rick
Graham stated the carport would be illegal. Chairperson Martin stated it had been
established at the previous meeting that the commission did not have the authority to
override the code of ordinances. The motion was taken to a vote and failed
unanimously.
Chairperson Martin stated this case was not approved by the Planning and Zoning
Commission. If the applicant does not agree with the Commission's decision, she can
submit an appeal to City Council. The appeal must be made within ten (10) calendar
days of this meeting. An Appeal Application is available from the Planning Office. A
$100.00 fee will be required when the application is submitted.
3. Case C 16-20
Request for a Conditional Use at 2719 Palmetto Drive to allow a carport in the
required front setback in a Single -Family 2 Residential (SF -2) zoning district.
Mrs. Cayce Wendebom made a motion to approve. Ms. Krystal James seconded.

Mr. Christopher Guess presented the application to allow a carport in the required front
setback at 2719 Palmetto Drive. The requested 20 ft. x 20 ft. carport would be located 9
ft. 7 in. from the front property line and 4 ft. from the interior side property line. There
were 5 properties within 200 ft. that had a carport within the front setback area. Staff
sent 28 notification letters; 3 responded in favor, 0 in opposition, and 0 with no
opinion/undecided. There were no responses received from outside the notification
area.
Mr. Guess stated staff recommended approval of the carport as submitted.
Chairperson Martin asked if the applicant was in attendance and wished to speak. Mr.
Nick Hurd, of 2701 Boulder Drive, stated he was the contractor overseeing the building
of the carport and he would be available to answer any questions from the commission.
Chairperson Martin asked if there was anyone else in the audience who wished to
speak, and there were none.
Chairperson Martin opened the motion to discussion among the commission. Mr. Rick
Graham asked if the carport was going to be constructed of metal or wood. Mr. Hurd
stated the carport would be constructed entirely of metal.
The motion was taken to a vote and carried unanimously.
4. Case C 16-21
Request for a Conditional Use at 111 South Kirkwall Circle to allow a carport in
the required front setback in a Single -Family 2 (SF -2) zoning district.
Mrs. Cayce Wendeborn made a motion to approve. Mr. Barney Brock seconded.
Mr. Christopher Guess presented the application to allow a carport in the required front
setback at 111 South Kirkwall Circle. The requested carport would be located in a
Single Family Residential (SF -2) zoning district. The proposed 20 ft. x 20 ft. carport
would be 10 ft. from the front property line, and 9 ft. 6 in. from the interior side property
line. There were 3 properties within 200 ft. that had a carport within the front setback
area. Staff sent 23 notification letters; 7 responded in favor, 0 in opposition, and 0 with
no opinion/undecided. There were no responses received from outside the notification
area.
Mr. Guess stated staff recommended approval of the carport as submitted.
Chairperson Martin asked if the applicant was in attendance and wished to speak. Mr.
Joel Gipson, of 123 Dundee Drive, stated the applicant had been unable to attend and
he would be available to answer any questions on his behalf. Chairperson Martin asked
if there was anyone else in the audience who wished to speak, and there were none.
Chairperson Martin opened the motion to discussion among the commission. Mr. Jerry
Beaver pointed out that the pictures showed some posts already having been installed
and asked if the applicant had begun the carport prematurely, or if the posts belonged to
a separate project. Mr. Gipson stated the applicant had begun the project prematurely.
Mr. Rick Graham asked if the proposed carport would be constructed entirely of metal.
Mr. Gipson responded that it would be metal.
