RESOLUTION APPROVING AGREEMENT FOR TEMPORARY PRIVATE
VEHICLE CROSSING WITH THE BURLINGTON NORTHERN AND
SANTA FE RAILWAY COMPANY AT THE CYPRESS WATER
TREATMENT PLANT, FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls desires to have a temporary private
crossing of the Burlington Northern and Santa Fe Railway Company at the Cypress
Water Treatment Plant; and,
WHEREAS, the Council has examined a proposed Agreement for Temporary
Private Crossing with the railway company for this purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTION 1 . The Agreement for Temporary Private Crossing of a railway right -
of -way belonging to the Burlington Northern and Santa Fe Railway Company is hereby
approved. The City Manager is authorized to execute the agreement for the City of
Wichita Falls and to make a payment of $22,319.00 to the railway company.
SEC TION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
