RESOLUTION OF THE CITY COUNCIL OF THE City OF WICHITA
FALLS, TEXAS, TO ACCEPT THE 2001 -2002 WATER BUDGET
UTILUIES PROJECT; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit price contract with DavConn
Construction Co., Inc with the estimated total cast of $343,278.00 and,
WHEREAS, the actual work was completed at a total cost of $355,611.00 of
which $33],830.45 has been previously paid to the contractor, and $2,501.66 has been
paid in claims, leaving a balance of $15,278.89 to be retained as liquidated damages.
WHEREAS, the City staff has inspected the work and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTION 1 . The 2001 -2002 Water Budget Utilities Improvement Project is
hereby accepted.
SECTION 2 . It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
