RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, APPROVING CHANGE ORDER NO 1 TO THE
MEMBRANE FACILITY PROJECT (CWF03- 544 -16) IN THE AMOUNT
OF $1,200 000.00 AND A LETTER OF AGREEMENT EXTENDING THE
CONTRACT COMPLETION DATES FOR THE MEMBRANE FACILITY
CONTRACT, YARD PIPING PHASE I CONTRACT, MEMBRANE
CLARIFIER CONTRACT AND THE FLOW CONTROL VAULT, SLUDGE
PUMP STATION NO 3 AND BRINE PUMP STATION CONTRACT',
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit price contract with MW
Builders of Texas with the estimated total cost of $14,177,000.00; and
WHEREAS, Change Order No 1 would add $1,200,000.00 to the contract for a
revised cost of $15,377,000.00', and
WHEREAS, the Letter of Agreement would extend the contract completion date
of the Membrane Facility, Membrane Clarifier, Yard Piping Phase I, and the Flow
Control Vault, Sludge Pump Station No. 3, and Brine Pump Station Contracts to June 3,
2005 with final completion of July 1, 2005, and
WHEREAS, the City staff has reviewed all aspects of this Change Order No. 1
and the Letter of Agreement and feels that it is in the City's best interest to approve.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTION 1 . Change Order No. 1 for the Membrane Facility Project (CWF03-
544 -16) and Letter of Agreement is hereby approved and the City Manager is
authorized to make amendments to this contract.
S ECTION 2 . It is hereby officially found and determined that the meeting at
which Nis resolution was passed was open to the public as required by law.
