RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, APPROVING AN AGREEMENT BETWEEN THE
WICHITA FALLS - WICHITA COUNTY PUBLIC HEALTH DISTRICT AND
THE MULTI - PURPOSE EVENTS CENTER CORPORATION FOR THE
USE OF MPEC PROPERTY DURING A PUBLIC HEALTH EMERGENCY;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, on the 27 day of July, 2005, an agreement was executed between
the Wichita Falls- Wichita County Public Health District and the Multi- Purpose Events
Center Corporation for use of the MPEC facilities in the event of a public health
emergency; and,
WHEREAS, the City of Wichita Falls, as an owner of the MPEC facilities,
consents and hereby approves of the agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . The Interlocal Cooperative Agreement dated July 27, 2005, a copy
of which is attached hereto, between the Wichita Falls- Wichita County Public Health
District and the Multi- Purpose Events Center Corporation is hereby approved.
SECTION 2 . It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.

INTERLOCAL COOPERATIVE AGREEMENT
THE STATE OF TEXAS:
COUNTY OF WICHITA:
This agreement ( "Agreement') is made by and between the Wichita Falls — Wichita
County Public Health District ( "Health District ") and the Multi- Purpose Events Center
( "MPEC ").
In accordance with the provisions of the Texas Government Code, Chapter 791,
Interlocal Cooperation Act, the parties to this Agreement desire to establish a cooperative
agreement for the utilization of resources for the benefit of the community to assist in
providing additional capacity for multiple functions during a declared public health
emergency.
In signing this Agreement, the MPEC authorizes the Health District to utilize MPEC
property during a public health emergency. Further, to the extent permitted by law and in
compliance with said law, the Health District may (a) request the use of specific
properties including buildings, structures and land; and (b) request the use of personnel to
assist in various capacities within their scope of training.
WHEREAS, the outbreak of disease from natural or man-made sources, or as the result of
an act or acts of bioterrorism can pose facility and manpower problems beyond the
capacity of most facilities that are pre- designated to handle the care of casualties and
fatalities; and
WHEREAS, a formal agreement between the Health District and the MPEC would allow
for better coordination of the effort to provide adequate facility space and manpower, and
help ensure that this effort is accomplished as quickly as possible if the need arises; and
WHEREAS, in order to protect the health and safety of the public throughout Wichita
County in the event of a local public health emergency or act of bioterrorism, the Local
Health Authority has been appointed, under contract with the City of Wichita Falls,
pursuant to Chapter 121 of the Texas Health & Safety Code; and
WHEREAS, the governing officials of the entities who have executed this Agreement of
identical counterparts, local governments, political subdivisions and public entities of the
State of Texas and the United States of America, collectively desire to secure for each
such entity the benefits of cooperation and protection of life and property in the event of
such an outbreak of disease;
This Agreement shall apply and remain in effect for a period of one year from the date of
execution and will renew automatically each year unless either party notifies the other in
writing 30 days prior to the end of the original term or of an automatically renewed term
that it wishes to terminate the Agreement.
The purpose of this cooperative is to increase the effectiveness and efficiency of resource
sharing between the Health District and the MPEC.
The goal of this cooperative is to obtain and maintain a written understanding between
the Health District and the MPEC for shared resources prior to a public health
emergency, which can be enacted in a time of need.
As administrator for the agreement, the Health District will:
1. Notify the MPEC Director regarding the activation of this agreement.
2. Ensure that proper records are maintained for any possibly financial
reimbursement that may result from the utilization of MPEC property.
As a participant in the agreement, the MPEC agrees to:
1. Allow for the use of MPEC property, when approved by the MPEC Director.
2. Provide a call roster for MPEC personnel to be notified on a 2417 basis in case
of activation of this agreement.
3. Update the Health District regarding any modifications or additions to
buildings that would significantly change the usage of said property.
This Agreement shall be construed to be in accordance with the laws of the State of
Texas.
