RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, ACCEPTING THE KICKAPOO DOWNTOWN AIRPARK
TAXIWAY B CONSTRUCTION PROJECT (CWF 03 -25) AND
AUTHORIZING FINAL PAYMENT TO JORDAN PAVING COMPANY,
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered into a contract with Jordan Paving
Company in the amount of $1,156,490.00; and
WHEREAS, the actual work was completed for a total cost of $1,135,774.56, of
which $1,078,985.84 has been previously paid to the contractor, leaving an amount due
of $56,788.72; and
WHEREAS, the contractor exceeded the allowable time period to complete the
job by forty -four (44) days and as per the contract, liquidated damages in the amount of
$500 per day, totaling $22,000.00, should be assessed making the final payment to the
contractor $34,788.72, and
WHEREAS, the City staff and the City's airport engineering consultant has
inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTION 1. The Kickapoo Downtown Airpark Taxiway B Construction Project is
hereby accepted, and the City Manager is authorized to make final payment to the
contractor in the amount of $34,788.72.
SECTIO 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
