RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AUTHORIZING THE CITY MANAGER TO DIRECT
THE PROPERTY ADMINISTRATOR TO PURCHASE A NINETY -ONE
(91) ACRE TRACT OF LAND KNOWN AS BLOCK 8, SOUTHSIDE
FARMS, LOCATED TO THE WEST OF WYLIE ROAD BETWEEN THE
WICHITA RIVER AND SEYMOUR HIGHWAY, WICHITA FALLS,
WICHITA COUNTY, TEXAS AND IMMEDIATELY ADJACENT TO THE
CITY LANDFILL, FOR THE PURPOSE OF PROVIDING A DIRT
SOURCE FOR DAILY AND INTERMEDIATE COVER IN AN EFFORT
TO HELP ELIMINATE THE CITY'S DIRT DEFICIT PROBLEMS;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, it is a necessity that the City of Wichita Falls acquire additional
resources of dirt for daily and intermediate trash cover at the landfill, and
WHEREAS, the amount of just compensation to be offered to the property owner,
who is a "willing seller" has been determined to be at the "fair market value "; and
WHEREAS, the ability to purchase property for cover in such close proximity to
the landfill results in a shorter and cheaper solution to the City's dirt deficit dilemma as
well as providing the City a buffer.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . It is necessary that the City of Wichita Falls acquire additional dirt
for trash cover at the landfill to remain in compliance.
SECTION 2 . The amount to be paid to willing seller is the "fair market value ".
SECTION 3. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
