RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, TO APPROVE AN AGREEMENT WITH TXU ELECTRIC
DELIVERY COMPANY FOR RELOCATION OF ELECTRIC UTILITIES
AFFECTED BY THE JASPER WATER TREATMENT PLANT
REHABILITATION AND IMPROVEMENT PROJECT (CWF04- 544 -21)',
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls is required to relocate electric utilities to
facilitate the construction of the Jasper Water Treatment Plant Rehabilitation and
Improvement Project and
WHEREAS, relocation work will be performed by TXU Electric Delivery
Company; and
WHEREAS, the City shall pay TXU Electric Delivery Company for its coal
incurred, estimated to be $112.955.52; and
WHEREAS, Staff has reviewed and is recommending the Agreement with TXU
ElecMC Delivery Company; and
WHEREAS, the Council has examined the proposed Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTION 1 . The proposed Agreement with TXU Decide Delivery Company for
electric utility relocations to facilitate the construction of the Jasper Water Treatment
Plant Rehabilitation and Improvements Project is hereby approved. The City Manager
is authorized to execute the Agreement for the City of Wichita Falls and to make a
payment of $112,955.52 to TXU Electric Delivery Company.
SECTION 2 . It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law,
PASSED AND APPROVED this the 4th day of January, 2005.
