RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, APPROVING SETTLEMENT AGREEMENT BETWEEN
THE STEERING COMMITTEE OF CITIES SERVED BY TXU ELECTRIC
DELIVERY AND THE ELECTRIC DELIVERY COMPANY; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, twenty -three cities who are members of the steering committee of
cities served by TXU have passed resolutions in 2004, requiring TXU Electric Delivery
to file Information that demonstrates good cause for showing that TXU Electric Delivery
transmission and distribution rates should not be reduced', and,
WHEREAS, the cities and TXU Electric Delivery desire to resolve all outstanding
Issues related to the existing and potential show -cause actions, and other regulatory
issues.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTION i . The settlement agreement dated February 22, 2005, between the
TXU Steering Committee Cities and TXU Electric Delivery Company Is hereby
approved.
S ECTION 2 . The City Manager Is authorized to execute any necessary
documents on behalf of the City of Wichita Falls for such settlement.
SECTION 3 . It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
