RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AGREEMENT WITH URS CORPORATION TO PROVIDE
CONSTRUCTION QUALITY ASSURANCE TESTING AND RESIDENT
PROJECT REPRESENTATIVE (RPR) SERVICES IN CONJUNCTION
WITH THE PHASE II AIRFIELD IMPROVEMENT PROJECT AT
KICKAPOO DOWNTOWN AIRPARK, FINDING AND DETERMINING
THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED
WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls has awarded a contract for Phase II Airfield
Improvements at Kickapoo Downtown Airpark, and
WHEREAS, the City of Wichita Falls desires construction Quality Assurance
Testing and Resident Project Representative (RPR) services be performed in
conjunction with the above referenced project;
WHEREAS, Federal Aviation Administration will fund 95% of cost for these
services and sufficient Kickapoo Downtown Airpark funds are available to fund the
additional 5% of the service agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SE CTION 1 . The City Manager is hereby authorized to execute the attached
agreement supplement with URS Corporation for construction Quality Assurance
Testing and Resident Project Representative (RPR) services in conjunction with the
Phase II Airfield Improvement Project at Kickapoo Downtown Airpark in the amount of
$150,710.43.
SE CTION 2 . It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.

L RESIDENT PROJECT REPRESENTATIVE SERVICES
A. GENERAL
URS Corporation will provide, through a qualified subconsultant, Resident Project
Representative (RPR) services. The RPR as the Engineer's agent, will act as directed by and
be trader supervision of the Engineer, and will confer with the Engineer regarding the RPR's
actions. The RPR's dealings in matters pertaining to the on -site work shall in general be only
with the Engineer and the Contractor, keeping the Owner /Sponsor advised as necessary, and
dealings with the subcontractors shall only be through or with the full knowledge of the
Contractor. Written communications with the Owner /Sponsor will be only through or as
directed by the Engineer.
B. DUTIES AND RESPONSIBILITIES OF THE RPR
The RPR shall:
I. Be thoroughly familiar with the plans and specifications as they appl to the
work being inspected, and review them frequently. 'the RPR must be capable
of immediately recognizing if the work conforms to the contract requirements.
2. Provide full time services at all times the Contractor conducts activities on the
construction site.
3. Serve as the Engineer's liaison with the Contractor, working principally
through the Contractor's superintendent and assist in understanding the intent
of the Contract Docmnents, and assist the Engineer in serving as the Owner's
liaison with the Contractor particularly when the Contractor's operations
affect the Owner's on -site operations.
4. Review the progress schedule, samples schedule of Shop Drawing submittals
and schedule of values prepared by the Contractor and consult with the
Engineer as to the acceptability of such schedules.
5. Act as the Engineer's Liaison:
i) Attend /conduct meetings with the Engineer. Owner and Contractor, such as
Pre- Construction Conferences, progress meetings, weekly construction

coordination meetings, job conferences and other project - related meetings,
and prepare and circulate copies of minutes thereof.
ii) assist in obtaining from the Owner additional details or information, when
required for proper execution of the Work.
6. Collect and transmit Stop Drawings and samples:
i) record date of receipt of Shop Drawings and samples.
ii) receive samples which are furnished at the site by the Contractor, and
notify the Engineer of the availability of samples for examination.
iii) advise the Engineer and Contractor of the commencement of any Work
requiring a Shop Drawing or sample if the submittal has not been approved by
the Engineer.
7. Review, rejection and correction of defective work, inspection and testing:
i) observe, review and test the Work throughout the construction
administration phase, as needed, to determine if the Work is proceeding in
accordance with the Contract Documents.
ii) reject, require correction, or uncovering of the Work for observation, or
require special testing, inspection or approval of the Work that in the opinion
of the RPR does not conform to the Contract Documents or is defective,
unsatisfactory, or faulty, and notify the Engineer and Owner in writing of the
reason for each such rejection, correction, and uncovering. The RPR shall
cvalriate, if requested by the Owner, the impact of each such rejection,
correction, and uncovering of the Work on the Contractor's scheduling.
iii) verify that tests, equipment and systems startups and operating and
maintenance training are conducted in the presence of appropriate personnel,
and that the Contractor maintains adequate records thereof; and observe,
record and report to the Engineer appropriate details relative to the test
procedures and startups .
iv) accompany visiting inspectors representing public or other agencies having
jurisdiction over the Project, record the results of these inspections and report
to the Engineer.
Maintain at the job site orderly files for correspondence, reports of job
conferences, Shop Drawings and samples, reproductions of original Contract
Documents, including all Work Directive Changes, Addenda, Change Orders,
Field Orders, additional drawings issued subsequent to the execution of the

Contract, Engineer's clarifications and interpretations of the Contract
llocuments, progress reports, and other project related documents.
9. Keep a diary or tog book, recording Contractor hours on the job site, weather
conditions, data relative to questions of Work Directive Changes, Change
Orders or changed conditions, list of job site visitors, daily activities,
decisions, observations in general, and specific observations in more detail as
in the case of observing test procedures, send topics to the Engineer, and
provide copies to the Owner upon request.
10. Record names, addresses and telephone numbers of all subcontractors and
major suppliers of materials and equipment.
11. Furnish the Engineer with weekly reports as required of progress of the Work
and of Contractor's compliance with the progress schedule of Shop Drawings
and sample submittals.
12. Consult with the Engineer in advance of scheduled major tests, inspections or
start of important phases of the Work.
i) draft proposed Change Orders and Work Directive Changes, obtaining
backup material from the Contractor and recommend to the Engineer Change
Orders, Work Directive Changes, and Field Orders.
13. Report immediately to the Engineer and Owner upon occurrence of any
accident.
14. Review applications for payments with the Contractor for compliance with the
established procedure for their submission and forward the recommendations
to the Engineer, noting particularly the relationship of the payment requested
to the schedule of values. Work completed, and materials and equipment
delivered at the site but not incorporated into the Work. The Engineer shall
then determine the amount owing to the Contractor and shall certify requests
for payment in such amounts, on the basis that the Work has progressed to the
point indicated and that the quality of the Work is in accordance with the
Contract Documents.
C. LIMITATIONS OF THE RFR'SI AUTHORITY
The Resident project Representative:
1. Shall not authorize any deviation from the Contract Documents or substitution
of materials or equipment, unless authorized by the Engineer.
2. Shalt not exceed the limitations of the Engineer's authority as set forth in the
Contract Documents and the Agreement.

3. Shall not undertake any of the responsibilities of the Contractor,
subcontractors, or Contractor's superintendent.
4. Shall not advise on, issue directions relative to or assume control over any
aspect of the means, methods, techniques, sequences or procedures of
construction unless such advice or directions are specifically required by the
Contract Documents.
Shall not advise on, issue directions regarding, or assume control over safety
precautions and programs in connection with the Work. However, the RPR
shall notify the Contractor, the Engineer, and the Owner of any safety
concerns the RPR may have, whether such matters relate to the Contractor, or
the Contractor's subcontractors or suppliers. Such notice shall be immediate
and when possible from the project site in order to allow, among other things,
the Owner the opportunity to have safe conditions for its employees.
6. Shall not accept Shop Drawings or samples from anyone other than the
Contractor.
D. COMPENSATION
Compensation for providing Resident Project Representative Services shall be based on an
actual cost basis, as invoices by the subconsultant, with an estimated fee of $89,600.00, not
to be exceeded without prior written authorization. The above estimate is based upon a
construction duration of 36 weeks, plus a 4 -week close -out period, for a total duration of 40
weeks of construction, and assumes an hourly rate of $42.00 per hour for an estimated 2,000
hours. In addition, 10 (ten) trip charges will be billed at a lump sum rate of $560.00 per trip
to compensate the RPR for travel and other expenses between the project site and his /her
home office.
11. MATERIALS ACCEPTANCE TESTING SERVICES
A. GENERAL
URS Corporation will provide, through a qualified subconsultant, quality assurance and
materials acceptance testing services. Quality assurance and materials acceptance testing
shall be performed in conformance with the requirements of the Specifications and Contract
Documents for the Project, Airfield Paving Improvements at the Wichita Falls Kickapoo
Downtown Airpark (AIP No. 3-48-0346-04).
B. DLTIES AND RESPONSIBILITIES
URS Corporation shall:

I. Be thoroughly familiar with the plans acrd specifications as they apply to the
quality assurance and materials testing requirements of the project;
2. Be prompt and responsive to requests from the Resident Project Representative
for quality assurance testing services;
3. Provide timely and accurate written reports of the material test results; and
4. Comply with the safety requirements of the Kickapoo Downtown Airpark related
to his operations on the Airfield.
C. COMPENSATION
Compensation for providing Materials and Acceptance Testing Services shall be based on an
actual cost basis, as invoiced by the subconsultant, with an estimated fee of $61,110.43, not
to be exceeded without prior written authorization. Rates for materials and acceptance
testing services shall be in accordance with the unit price fees established in the attached
Materials and Acceptance Testing Program dated July 7, 2004.
