Ordinance Amending Sections 6720 And 6745 And Table 6741 And
Its Associated Notes Of Appendix B, "Zoning," Of The Code Of
Ordinances Of The City Of Wichita Falls To Allow Noncommercial
Signs To Be Placed On Nonresidential Property, Providing For A
Penalty Not To Exceed $2,000 Per Violation; And Providing For
Codification
WHEREAS, the City's Planning and Zoning Commission has reviewed this
proposal and recommends approval of these amendments to the Zoning Ordinance;
WHEREAS, the City Council concurs with the Planning and Zoning
Commission's recommendation to amend the Zoning Ordinance; and
WHEREAS, the City Council finds that the proposed ordinance is content neutral
and is the least restrictive means of providing for the valid regulatory objectives of the
City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. Noncommercial Signs Defined in Section 6720
Section 6720 of Appendix B of the Code of Ordinances of the City of Wichita
Falls is hereby amended by adding the following definition in its proper alphabetical
order:
Noncommercial Sign: Any sign no larger than 32 sq. ft. in area containing a noncommercial
message and placed on a non-residential property. Such signs shall include but not be limited to
the advertising of celebrations, exhibitions, community events, or activities of churches or other
charitable,non-profit, educational or philanthropic organizations.
2. Noncommercial Signs Added to Table 6741
Table 6741 of Appendix B of the Code of Ordinances of the City of Wichita Falls
is hereby amended to read as follows by adding Noncommercial sign and its limitations
to the table and adding a reference to Note 9 under special requirements for political
signs. Added text is denoted by underline, and deleted text is denoted by strikethrough.

3. Noncommercial Messages May be Displayed on Commercial Signs
The associated notes of Table 6741 of Appendix B of the Code of Ordinances of
the City of Wichita Falls are hereby amended to add Note 9 in its proper numerical
order, which shall read as follows:
NOTE 9
A property owner may choose to display a political or other noncommercial message on
any authorized commercial sign, subject to the payment of fees and regulations applicable
to signs with commercial messages.
4. Exceptions to Permit Requirements
Section 6745 of Appendix B of the Code of Ordinances of the City of Wichita
Falls is hereby amended by adding "noncommercial signs" to the paragraph titled
Exceptions to permit requirements, with said paragraph to read as follows (added text
denoted by underline):
Exceptions to permit requirement. The following signs are exempt from the requirement for a
permit:
i. directional signs,
ii. non-commercial signs,
iii. political signs,
iv. residential signs,
v. temporary residential signs,
vi. temporary commercial signs I and I1,
vii. temporary commercial signs III when 64 sq. ft. or less in area,
viii. wall signs that do not project beyond the face of the wall more than 12 inches,
ix. temporary signs providing legal notice required by law of Local, State, or Federal
Government, and
x. seasonal displays and decorations which do not advertise a product or service.
Exemptions from the necessity of securing a permit, however, shall not be construed to relieve
the owner of the sign involved from responsibility for its erection and maintenance in a safe
manner and in a manner in accordance with all the other provisions of this ordinance.
5. Penalty
This ordinance regulates zoning, and shall be punishable by a penalty of up to
$2,000 per violation and as provided by Section 1-14 of the Wichita Falls Code of
Ordinances.
6. Codification
The City Council intends the provisions of this ordinance to become a part of the
Code of Ordinances of the City of Wichita Falls, and sections of this ordinance may be
renumbered or relettered to accomplish such intention. Statutory and ordinance
references herein may be modified as necessary.
