Ordinance Appropriating $55,000 From General Fund Reserves To
The 2011 -12 Budget For The Settlement Of City Of Wichita Falls V.
Steve Fontenot And Civil Service Issues Related Thereto,
Authorizing The Execution Of Settlement Documents, Declaring An
Emergency, And Providing An Effective Date
WHEREAS, the City's 2011 -12 budget includes $25,000 for miscellaneous court
costs and legal settlements throughout the fiscal year; and
WHEREAS, the City Council desires to settle a court case in the amount of
$55,000.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The sum of $55,000 is appropriated from General Fund Reserves to the City's
Fiscal Year 2011 -12 budget to provide for the settlement of City of Wichita Falls vs.
Steve Fontenot and civil service issues related thereto.
2. City Staff is authorized to execute documents necessary to settle the
aforementioned suit and civil service issues related thereto, in a form to be approved by
the City Attorney.
3. It is hereby found and determined that the subject matter of this ordinance
affects the public health, safety, and general welfare of the citizens of Wichita Falls and
that immediate effectiveness of this ordinance is necessary to provide for the position
held by the police officer at issue herein to be filled; therefore, this ordinance is declared
to be an emergency measure and shall become effective immediately upon its passage.
