Res 043-2009 3/3/2009 RESOLUTION NO. �7�� RESOLUTION APPROVING RESIDENT PROJECT REPRESENTATIVE (RPR) AND ACCEPTANCE TESTING SERVICES CONTRACT TO URS CORPORATION IN CONJUNCTION WITH THE T-HANGAR CONSTRUCTION PROJECT AT KICKAPOO DOWNTOWN AIRPORT.; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls desires to enter into an RPR and acceptance testing services contract for the t-hangar construction project at the Kickapoo Downtown Airport, and WHEREAS, URS Corporation is proposing to do this work for the amount of $24,757.39. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The RPR and acceptance testing services contract from URS Corporation for the t-hangar construction project at Kickapoo Downtown Airport, is hereby accepted. SECTION 2. The WORK to which this ORDER applies is Resident Project RepraseMation (RPR) and Aoce�taace Testing Services for the New 6-Unit T-Hangar Project at the �chita Falls Kickapoo Downtown Airport. 'fhc ENGINEER shall, in tt►e scope of iheir work, perform the following basic services for the WORK: I. RESIDENT PROJF.CT REPRESENTATION (6 WEEKS DIJRATION) A. GENERAL The Resident Project Reprasen�tive (RPR) as the Engineer's agent, will act as directed by and under snpa�vision of the Enginxr, and will confer with the Engineer regarding the RPR's actions. The RPR's dealings in matters pertaining to the on-site work shall in general be only with the Engineer and the Contra�-'cor, kceping the Owner/Sponsor advised as necessary, and dealings with the subconttactors shall oniy be tluough or with the full knowladge of the ContracWr. Written communications with the Owner/Sponsor will be only through or as directed by the Engineer. B. DUTIES AND RESPONSIBILITIES OF THE RPR The RPR shell: I. Be thoroughly familiar with the plans and specifications as they apply to the work being icnpexted, and review them fiequenUy. The RPR must be capable of immediately recognizing if the work confomu to the oont�acl requirements. 2. Provide full time services at all times the ConuacWr conducts activities on the construction site. 3. Serve as the Engineer's lisison with the Conuactor, working principally through the Contractor's superiMendent and assist in understanding the intent of the Conhact Documents, m►d assist the Engineer in scrving as the Owner's liaison with the Contractor particularly when the Contractor's operatioas affect the Owner's on-site operations. 4. Review the p�ogress sctredule, samples schedule of Shop Drawing submittals and schedule of values prepared by the Contiactor and consult with the Engineer as to the acceptability of such schedules. A-1 s. wct as d�e Eogineex's L'�aison: i) Attend/oonduct mcerings with thc Engineer, Owner and ConUSCtor, such as Pro- Consin�ction Conferonces, progress meetings, weerly constructian coordination meetings, job conferences and aher project-related meetings, and prepere and circulate copies of minutes the�of. ii) assist in obtaining from the Owner additional details or infortnation, when required for proper exacution of the Worlc. 6. Collect and hansmit Shop Drawings and samples: i) record date of receipt of Shop Drawings and samples. ii) receive samples which are fumished at the site by the ConUactor, and notify the Engineer of the availabiliry of samples for examination. iii) advise tt�e Engineer and Conuador of the commen�t of any Work requiring a Shap Drawing or samplc ifthe submitlal has rat been approved by the Engineer. 7. Review, rejoction and cortxrion of dtfective work, inspoction and testing: i) observe, review and test the Work throughout the construction administration phase, as nceded, to determine if the Work is proceeding in accordance with the Contract Documents. ii) reject, requine corredion, or uncovering of the Work for observation, or require specia! testmg, inspection or approval of tfie Wodc that in the opinion of the RPR does not oonform w the Conhact Documents or is defedive, unsatisfactory, or faulty, arKi notify the Enginar and Owner in writing of the reason for each such rejection, corrcction, and uncovering. 77�e RPR shall evaluate, if requested by the Owner, the impact of �ach such rejeaion, oorrection, and uncovering of the Work on the Contrector's scheduling. iii) verify that tests, equipment and systems startups aad operating and maintenance training are conducted in the presence of appmpriate pecsonnel, and that the Conhactor maintains adequste records theroof; ard observe, record and report to the EnB�� ePP�nPryate details relative w the test procedutes and startups. iv) accompany visiting inspecO�rs rtpresendng public or othcr agencies having jurisdiction over the Project, record the resulu of these inspectans and report to the Eogineer. 8. Maintain at the job site orderly files for correspondence, reports of job conferences, Shop Drawings and samples, reproductions of original Contract Document�, including all Work Directive Chang�s, Addenda, Change Orders, Field Orders, edditional drewings issued A-2 subsequent to the execution of the Contract, Engineer's clari6catio� and inle�pretations of the Contrad Documents. Keep a diary or log boolc, recording Contractor hours on the job site, weaiher conditions, data relative to questions of Woric Directive Changes, Change Orders or changed conditions, list of job site visitors, daily activities, decisions, observations in general, and specific ohservations in more detail as in the case of observing test procedw+es, send wpies to the Engincer, and provide copies to tt►e Owner upon request 10. Rccord nama, addresus and telephone numbers of all subcontractors and major suppliers of materials and equipmen� 11. Fumish the Engii►eer' with wakly reports as rcquired of progress of the Wotic and of Contcactor's compliance with the progress schedule of Shop Drawings and sample submittals. 12. Consult with tAe Engineer in advance of scheduled major tesu, inspactions or statt of impormnt phbus of d�e Work. i) diaft proposed Change Orders and Work Diroctive Changes, obtaining beckup mate�ial fran the Contractor and r000mmend to the Enginoer Change Orders, Work Directive Changes, end Fidd Ordets. 13. Report immodiately to the Engincer and Owner apon occumence of any accident. 14. Review applications for payments with the Conuactor for compliancx with the established procedure for t6eir submission and forward the �ecommendatio�u to the Engineer, noring perticularly the rela6onship of the payment raquested to the schedule of values, Work completed, and materials and equipment delivered at the site but rat incorporated irrto the Worlc. The Engiecer shall then deteimine the amount owing to the Contractor and sha11 oertify roquests for payment in such amounts, on ihe basis d�at the Work has progressed to the poim indic�ted and diat the quality of the Work is in socordance witfi the Contract Documents� C. LlMlTATIONS OF THE RPR'S AUTHORITY The Resident Project Representativc: t. Shall not suthorize aay dcviation from ihe Conuact Documena or subsritution of materisls or equiprt�ent, �mless authorized by the Enginxr. 2. Shall not underiake any of the responsibilities of the Contractor, subco�mactors, or Contractor's superintendent. A-3 4. Shall not advisc on, issua dircttions rolative to or assume control over any aspect of the means, methods, techniques, sequences or procedures of construction untess such advice or directions are specifically requit+ed by the Conuact Documenu. 5. Shsll not advise on, issue ditections regarding, or assume control over safety precautians and programs in connxtion with the Work. However, the RPR shall notify the ConUactor, the Engineer, and the Owner of any safety ooncerns the RP[t may have, whetfier such mattets relate to the Contractor, or the Contract4r's subconbactors or suppliers.
