L. "hitham & Company. WHEREAS, the said L. E. dhitham & Company has fully per- formed its said contract and tree said imorovements have been made and constructed in accordance with the said contract and the specifications therefor, and to the entire satisfaction of this Board: I. That the said improvements on said portion of said street be and the same are hereby accepted and L. 0. Whitham & Co., and the sureties on its construction bond are hereby released of any further obligation for or on account of the contract or bond for the making and constructing of said improvements. II. 'that this resolution does not and shall not in any wise effect the bond of the said company for the maintenance of the said improvements, but such maintenance bond shall and, does remain in full force and effect. That the 1"ayor and City Clerk be and they are hereby authorized, instructed, and directed to issue to L. The City Engineer is hereby directed to have plans, profiles, specifications and estimates embracing the Foregoing materials and plans of improvements prepared, and to file the same with the Board of Alder yen, the City Engineer being so instructed, there being no City Manager. The said improvements shall be _;laid for in the fol- lowing manner, to -wit: The benefited and abutting property, and the owners thereof, shall be assessed and pay for all of the cost of installing curbs and not exceeding ninety per cent of 'the remaining cost of such improvements and the City of Ilichita Palls shall pay the reriainder. The sums payable by the benefited property and owners thereof shall be payable in six (6) equal installments, the first of tih i.ch shall be due on or before thirty (30) days after date of co pletion and acceptance by the City of such improvemeiits; the second shall be due on or before one (1) ear after such date; the third shall be rue on or before two (2) years after such date; the fourth shall be due on or before three (3) years alter such date; the fifth shall be due on or before four (4) years after such date and the sixth shall be due on or before five (5) ;years after such date, the entire amount of such sums shall bear interest from the date of such completion and acceptance and until paid at the rate of eight'_ -:per cent per annurl, payable annually, but such property, and the owners thereof, shall have the privilege of paying any or all of such in- stallments at any time before maturity, and the failure to� pay any install- aient u-oon the maturity thereof shall at the o;.)tion of the owne-rx -and holder of the certificate of special assessment issued in evidence the'reof,matur.e the entire amount then unpaid; and the sums payable by the respective lots or parcels of property abutting upon the said improvement, and benefited thereby, shall be assessed against such lots or parcels anal against the oriners thereof, and shall be a personal liability of such owner and a first and prior lien and charge against such property, superior to alb'' other liens, claims and charges and der _iands of whatsoever kind, excepting only State, County and :unicipal taxes. No assessment shall be levied against any lot or par- cel of land, or the owner thereof, in excess of the special benefits to such lot or parcel of land in enhanced value thereof by reans of such irlprovelnent, and no assessment shall be levied until after the notice and hearing as protided in the Charter and Laws in force and effect in this City, and in the ordinance and proceedin€'s of the board of Aldermen applicable thereto.
