I.
It is necessary that the unpaved s id pwalrs on the ';Jest
side of Filmore :Street between Ave. G, and Ave H, be improved by
raising, grading, filling, and paving same, and that sar_,re be im-
proved with ene of the following materials, to -wit:
(a) One Course concrete 2avernent,
II.
The City Engineer is hereby directed to have plans,
profiles, specifications. and estimates er_lbracing the foregoing
materials and plans of improvement prepared, and to file same
with the Board of Aldermen, the City Engineer beinf�, so directed
there being no Uity i; anage r.
The said iraprover�ents shall be paid for in the following
mariner,_ to -wit:
The benefited and abutting property, and the oiwiers there-
of, shall be assessed and pay for all cost of installing curbs and
not exceeding ninety per cent of the remaining cost of such imp-
rovements, and the City of :`Ji chi to Falls shall pay the remainder.
The sums payable by the benefited property and owners
thereof shall be payable in three equal installments, the first of
which shall be due thirty days after the completion and acceptance
by the City of such improvements, and the second shall be due on or
efo re one (1) year after such completion and acceptance, and the

The entire amount of the sums .;hall bear interest
from the date of such completion and acceptance and until paid at the
rate of eiEbt per cent (8�b) per annum, payable annually, but such prop-

all of such installments at any time before naturity, and the failure
to pay any installments upon maturity thereof shall at the option of
the owner and holder of the certi-ficate of special assess.ient issied
in evidence thereof mature the entire amount unpaid; and the sums pay-
able by the resy)ective lots or parcels of lend or pro-nerty abutting
upon said improvement and benefited the reby, shall be assessed asrainst
such lots or parcels and against the o,9m e rs tY ere of , and shall be a
personal liability of such olme-r and a first and prior.lien and charge
against such property, sun_ erior to all other. liens, claLms and charges
and demands of whatsoever kind excepting only State, County, and �Iun-
icipal taxes.
No assessment ;:hall be levied against an�7 lot or
parcel of land, or the owner thereof in excess of the special benefits
of such lot or parcel of land in enhanced value thereof by means of
such improvement, and. no assessiient shall be levied until after the
notice and hearing as provided in the Charter and Laws in force and
effect in this City, and in the ordinance and proceedings of the Beard
of Aldermen applicable thereto.

Upon the completion and acceptance of such improvers.@
ents and containing recitals lawful and properly applicable thereto
and the said improvements shall be executed, and the said matters filed
said notice and hearing ordered given, and ordinance levying the assess-
ment and any other clatters with reference to said improvement shall be
done and performed in the manner and form provided by the Charter and
Laws -in forcd and effect in,this City, and the ]proceedings, ordinances
and resolutions of the I:oard of nl dermen.

This resolution shall take effect from and after
its passage.

lared the necessity of improving the unpffved sidewalks on the lest
