Ordinance Suspending The Application Of The Dangerous Building
Order Of Ordinance No. 27 -2011 to 413 Dallas To Grant Additional
Time For Its Restoration
WHEREAS, the City Council included the property at N 1/ Lot 7 Blk 11 Kemp
(aka 413 Dallas) in a list of properties that were declared hazardous structures on June
7, 2011, and it was ordered to be demolished, and the City Council now desires to
grant additional time to rehabilitate this property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The dangerous building demolition order for 413 Dallas is suspended for the
additional time of 180 days from this day, and the dangerous building demolition order
is to be valid again if the property owner does not obtain a building permit to restore
this building within such time. If the property owner obtains a building permit to restore
this building within the aforementioned period of time, then the dangerous building
declaration for this property is suspended for the additional time of 180 days, and the
dangerous building demolition order is to be valid again if the property owner does not
bring this building into compliance with all codes of the City of Wichita Falls within the
aforementioned 180 days. If the property owner brings this building into compliance
with all codes of the City of Wichita Falls within the aforementioned 180 days, then this
dangerous building order will be terminated. The owner's failure to comply with either of
the aforementioned deadlines will authorize the City to demolish the structure without
further notification to the owner or any other party.
2. The City Council declares that the subject matter of this ordinance affects an
urgent public need for the preservation of the peace, health and safety of property of
the City of Wichita Falls by providing for the rehabilitation of an otherwise abandoned
structure; therefore, this ordinance is declared to be an emergency measure and shall
become effective immediately upon its passage.
