Min 04/05/2016 CITY COUNCIL MINUTES April 5, 2016 Page 1 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building April 5, 2016 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o’clock a.m., with the following members present. Glenn Barham - Mayor DeAndra Chenault - Councilors Tim Ingle - Brian Hooker - Stephen Santellana - Tom Quintero - Michael Smith - Darron Leiker - City Manager Kinley Hegglund - City Attorney Tracy Norr - City Clerk - - - - - - - - Mayor Barham called the meeting to order at 8:30 a.m. - - - - - - - - Item 2a - Invocation Councilor Smith gave the invocation. - - - - - - - - Item 2b - Pledge of Allegiance Mayor Barham led in the Pledge of Allegiance. - - - - - - - - Item 3a – - Employee of the Month – David “Bret” Davis, AT&T/Traffic 8:30:58 AM Mark Beauchamp recognized Bret Davis, AT&T/Traffic, as the Employee of the Month. Mayor Barham presented a plaque, a letter of appreciation, restaurant tickets, and a check to Mr. Davis and thanked him for his service - - - - - - - - CITY COUNCIL MINUTES April 5, 2016 Page 2 Item 3b – Proclamation – 100 Years of ROTC and JROTC, Wichita Falls ISD 8:34:56 AM Mayor Barham read a proclamation recognizing 100 years of ROTC and Junior ROTC in Wichita Falls. He urged citizens to support those involved in ROTC and JROTC. Officer Vance, JROTC, said there will be activities on April 23 at the armory. He invited all to participate. - - - - - - - - Item 3c – Proclamation – National Child Abuse Prevention Month, Child Abuse Prevention Committee 8:38:10 AM Mayor Barham read a proclamation establishing April 2016 as Child Abuse Prevention Month in Wichita Falls and encouraged citizens to increase citizens to increase their efforts in preventing child abuse. A representative of the Child Abuse Prevention Committee invited attendance at events to help awareness of child abuse problems in the city. - - - - - - - - Item 3d – Proclamation – National Public Health Week, Wichita Falls-Wichita County Public Health District 8:41:35 AM Mayor Barham read a proclamation establishing April 4-10, 2016 as National Public Health Week in Wichita Falls and urged citizens to observe the week by helping others better understand the value of public health and adopt healthy lifestyle habits. Lou Kreidler said the public health department celebrates public health every day. She recognized the employees who are active in the community. She also invited attendance at the upcoming public health fair. She noted the health themes for each day during the week. - - - - - - - - Item 4 - Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda. 8:46:11 AM Shirley Fox, 3204 Garfield Street, addressed the council about denial of water service at her home. She said she cannot get water service at the home she is now leasing because of a prior balance at the address. Mayor Barham said the only recourse is to check with staff and a decision will be made within a day or two. Christopher Carter, 105 Pioneer #B, spoke about bus service. He said there is a great transit system but the times are not convenient to people with disabilities. He needs service during evenings and weekends for his employment and that there are others who need service to get to work and activities. Mayor Barham suggested Mr. Carter speak with John Burrus CITY COUNCIL MINUTES April 5, 2016 Page 3 about options. Mr. Burrus said it is a matter of funding. He said a presentation was made during the planning meetings about a grant that will pay for services just as Mr. Carter described. There were no other citizen comments given. - - - - - - - Item 5 – 6c - Consent Items 8:54:08 AM City Manager Darron Leiker gave a briefing on the item listed under the Consent Agenda. Mo ved by Councilor Smith that the consent items be approved. Motion seconded by Councilor Ingle and carried by the following vote: Ayes: Mayor Barham, Councilors Chenault, Ingle, Quintero, Santellana, Smith, and Hooker. Nays: None Item 5 - Approval of Minutes of the March 15, 2016 Regular Meeting of the Mayor and City Council Item 6 – Receive Minutes Minutes of the following boards and commissions were received: (a) Planning and Zoning Commission, February 10, 2016 (b) Wichita Falls Economic Development Corporation, February 18, 2016 (c) Park Board, February 26, 2016 Item 7a – Ordinance #10-2016 8:54:47 AM ORDINANCE NO. 10-2016 Ordinance Appropriating $10,000 to the Special Revenue Fund for Additional Grant Revenue from the State of Texas for the Texas Department of Transportation Selective Traffic Enforcement Program (“STEP” or “Click It or Ticket”) Wave Grant for Fiscal Year 2016 and Authorizing the City Manager to Accept Said Funds Moved by Councilor Hooker that Ordinance #10-2016 be passed. Motion seconded by Councilor Ingle and carried by the following vote: Ayes: Mayor Barham, Councilors Chenault, Ingle, Quintero, Santellana, Smith, and Hooker. Nays: None - - - - - - - CITY COUNCIL MINUTES April 5, 2016 Page 4 Item 7b – Ordinance #11-2016 8:56:58 AM ORDINANCE NO. 11-2016 Ordinance Authorizing the Issuance of City of Wichita Falls, Texas Water and Sewer System Revenue Refunding Bonds, Series 2016; Establishing Procedures and Delegating Authority for the Sale and Delivery of the Bonds; Providing for the Security for and Payment of Such Bonds; and Authorizing and Enacting Other Matters and Provisions Relating to the Subject Moved by Councilor Ingle that Ordinance #11-2016 be passed. Motion seconded by Councilor Hooker. Murphy Davis, Century Management, stated the refunding of the bonds will save the city approximately $1 million every year. The ordinance presented will set parameters for the refunding of the bond to allow the staff authorization to act on the fin ancing without scheduling an additional council meeting when terms are met. He expects action by mid-May. He said the bond covenants will be amended during this time period. Motion carried by the following vote: Ayes: Mayor Barham, Councilors Chenault, Ingle, Quintero, Santellana, Smith, and Hooker. Nays: None - - - - - - - Item 8a – Resolution #35-2016 9:32:49 AM RESOLUTION NO. 35-2016 Resolution Appointing a Representative to the Wichita -Wilbarger 9-1-1 District Board Moved by Councilor Ingle that Resolution No. 35-2016 be passed. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Barham, Councilors Chenault, Ingle, Quintero, Santellana, Smith, and Hooker. Nays: None - - - - - - - - Item 8b – Resolution #36-2016 9:34:02 AM RESOLUTION NO. 36-2016 Resolution Approving the Programs and Expenditures of the Wichita Falls Economic Development Corporation (WFEDC) and Amending the Budget to Include Up to CITY COUNCIL MINUTES April 5, 2016 Page 5 $2,600,000 for Improvements and Expenditures Related to the Former Stanley Tools Building Located at 2801 Production Boulevard, and Up to $121,000 for Consulting Services to be Provided by Bruce Facility Planning Consultants Moved by Councilor Ingle that Resolution No. 36-2016 be passed. Motion seconded by Councilor Hooker and carried by the following vote: Ayes: Mayor Barham, Councilors Chenault, Ingle, Quintero, Santellana, Smith, and Hooker. Nays: None - - - - - - - - Item 8c – Resolution #37-2016 9:37:25 AM RESOLUTION NO. 37-2016 Resolution Approving a Fourth Generation Non-Annexation Agreement with P&WC Component Repairs (Wichita Falls) Guaranteeing Its Immunity from Annexation for a Period of Six Years Beginning January 1, 2016 Moved by Councilor Ingle that Resolution No. 37-2016 be passed. Motion seconded by Councilor Hooker and carried by the following vote: Ayes: Mayor Barham, Councilors Chenault, Ingle, Quintero, Santellana, Smith, and Hooker. Nays: None - - - - - - - - Item 8d – Resolution #38-2016 9:41:41 AM RESOLUTION NO. 38-2016 Resolution Awarding Bid and Contract for the 2016 Old Iowa Park Road Intersection Drainage Improvements Project to Jennifer McGrath dba McGrath Concrete Construction in the Amount of $63,539.00 Moved by Councilor Ingle that Resolution No. 38-2016 be passed. Nays: None - - - - - - - - CITY COUNCIL MINUTES April 5, 2016 Page 6 Item 8e – Resolution #39-2016 9:45:23 AM RESOLUTION NO. 39-2016 Resolution Authorizing the City Manager to Execute an Amendment to the Contract with Carollo Engineers, Inc. for an Extra Services Task in the Amount of $23,800 for a Water Quality Study of the Proposed Paddling Trail in Lake Wichita Park as Part of the 404 Permit Application to the U.S. Army Corps of Engineers Moved by Councilor Ingle that Resolution No. 39-2016 be passed. Motion seconded by Councilor Santellana and carried by the following vote: Ayes: Mayor Barham, Councilors Chenault, Ingle, Quintero, Santellana, Smith, and Hooker. Nays: None - - - - - - - - Item 9a – Staff Reports There were no staff reports. - - - - - - - - Item 9b – Items of Concern to Members of the City Council 9:50:19 AM Members of the City Council presented the following matters: Councilor Smith spoke about the many activities in Wichita Falls, including Cowboy True which he attended during the past weekend. Councilor Ingle said Marie Libby Day at the Chamber of Commerce was last week. He said the Zavala scholarship dinner was held past weekend. Councilor Quintero thanked the staff for helping address concerns of citizens in his district. He said we need a dditional public information that it is illegal to blow grass clippings into the street. Mayor Barham said he was fortunate to participate in the Wounded Warriors veterans hog hunt this past weekend. - - - - - - - - Item 10 - Adjourn City Council adjourned at 9:55:32 AM.
