Res 076-2011 9/6/2011 RESOLUTION NO. _76-2011__ Resolution Authorizing The City Manager To Execute Interlocal Agreements With Local Volunteer Fire Departments For The Purchase Of Fuel. WHEREAS, volunteer fire departments are nonprofit, emergency responders for county and regional emergencies; WHEREAS, the City of Wichita Falls and regional volunteer fire departments work together on many emergency response scenarios; WHEREAS, volunteer fire departments require diesel and unleaded fuel for county and regional emergency responses; and WHEREAS, the City of Wichita Falls desires to enter into an Interlocal agreement to allow for the sale of fuel to volunteer fire departments. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Interlocal Agreement The City Manager is authorized to execute the attached with local volunteer fire departments for the purchase of diesel and unleaded fuel, with changes as approved by the City Attorney. th PASSED AND APPROVED this the 6 day of September, 2011. ______________________________ M A Y O R ATTEST: ____________________ City Clerk INTERLOCAL AGREEMENT Under the authority of T.G’.CChapter 791, this Interlocal Agreement is made EX OVT ODE and entered into by and between the City of Wichita Falls (“City”), located in Wichita County, Texas, and _________________________ (“VFD”). W, the CITY will provide diesel and unleaded fueling services to VFD at a HEREAS reduced rate. Upon entering into this agreement, CITY and VFD agree to the following: I. CITY Duties 1)CITY will sell to VFD diesel and unleaded fuels directly from the Central Services fueling site. 2)CITY will sell to VFD said fuel at a cost per gallon equal to the CITY’s cost to acquire the fuel, plus implement an additional $0.15 per gallon markup for the fuel to cover administrative expenses and fuel equipment maintenance. 3)CITY may provide bulk fuel deliveries to VFD if VFD has a state and federally approved bulk storage unit. Bulk deliveries will occur per CITY’s delivery schedule. City will charge a fee to VFD in addition to the fees set out in I.2. to cover CITY’s costs for bulk fuel deliveries th 4)CITY will bill VFD on the 10 of each month for all diesel and unleaded fuel purchased the previous month. 5)CITY will provide VFD with fueling cards to allow for 24 hour access to the diesel and unleaded fueling pumps located at the Central Services facility site. 6)CITY will provide air for tire service its Central Services Complex. II. VFD Duties 1)VFD agrees to pay CITY within 30 days of invoice for diesel and unleaded fuel purchased. Failure to pay within 30 day of invoice date will result in the immediate termination of this agreement. 2)The diesel and unleaded fuel purchased by VFD shall only be used by VFD fire fighting motor vehicles and equipment. 3)VFD will not fuel personal vehicles with fuel purchased from City. A personal vehicle is defined as a vehicle that is not fully owned by the VFD and is one that the VFD does not carry insurance. Violation of this clause will result in the immediate termination of this agreement. 4)VFD agrees to not use oil and other fluids, other than water for coolant purposes, provided at CITY Central Services fuel pumps for CITY use. 5)VFD will keep the fueling station clean of any trash and debris. III. Joint Duties 1)The PARTIES shall designate Wade Looney, CITY Automotive Services Coordinator, and_______________________, VFD President, as the primary contact persons for all matters relating to this agreement and services provided. 2)The PARTIES shall commit to cooperative processes that will make the agreement successful. 3)The PARTIES shall meet annually to review services provided in this agreement. This agreement will become effective __________________________ and will remain in effect until September 30, 2012, unless otherwise amended by mutual agreement or terminated by any party by written notice of at least thirty (30) days in advance of the cancellation or September 30, 2012, whichever comes first.
