ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING CHAPTER 106 OF THE CODE OF
ORDINANCES TO ADD SECTION 106 -128 ENTITLED "CREDIT CARD
PAYMENTS; PROCESSING FEES "; FINDING AND DETERMINING
THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED
WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, one of the Finance Department goals is to provide a more
convenient payment center for City utility customers; and
WHEREAS, acceptance of credit cards would offer customers a payment method
that is currently not accepted; and
WHEREAS, the Local Government Code allows municipalities to charge a
processing fee to recover reasonable costs incurred by the municipality in accepting
credit card payments; and
WHEREAS, staff estimates that there will be some additional administrative tasks
involved in accepting credit card payments and the costs incurred for these tasks will be
the same for each transaction regardless of the amount of the credit card charges.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Chapter 106 of the Code of Ordinances is hereby amended to add
Section 106 -128 to read as follows:
`Sec. 106 -128. Credit Card Payments; Processing Fees.
(a) The Utility Collection Division may accept credit cards from Visa and
Master Card for payments collected by the Utility Collection Division from
residential customers.
(b) A processing fee of $ , ()p per transaction shall be assessed to the
customers paying by credit card to reimburse the City for reasonable
expenses incurred to process the transaction.

(c) If the processing fee described in Section 106 -128 (b) exceeds five
percent (5 %) of the total charges paid for with a credit card, then a
processing fee of five percent (5 %) of the total charges shall be assessed.'
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
