ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, WAIVING SECTION 94- 128(a)(3) WITH RESPECT TO
PLACING SIDEWALK ON CRESCENT LANE, LOT 1 CAPITAL
ADDITION SUBDIVISION; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, it is the intent of the subject section of the Code of Ordinances of
the City of Wichita Falls, Texas to provide for the proper and orderly development of
land inside city limits and extraterritorial jurisdiction; and
WHEREAS, the granting of a waiver with respect to Section 94 -128 (a) (3) which
requires the construction of sidewalk for commercial and industrial establishments: or a
cash deposit in lieu of the construction of the sidewalk on the property, would not be
contrary to the stated objective when applied to the west line of Lot 1, Capital Addition
Subdivision.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Said requirement for sidewalk along Crescent Lane from the sewer
easement to the north property line, along the west line of Lot 1, Capital Addition
Subdivision is hereby suspended pending development of the described area in a
manner requiring a building permit.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
