ORDINANCE REZONING A 0.6608 ACRE TRACT OF LAND OUT OF
BLOCK 10, DENTON COUNTY SCHOOL LANDS, LEAGUE 1,
ABSTRACT 58, WICHITA COUNTY, TEXAS, SAID TRACT ALSO BEING
A PORTION OF LOT 10 -A, BLOCK 19, FOUNTAIN PARK, SECTION 4 -A,
AN ADDITON TO THE CITY OF WICHITA FALLS, TEXAS, FROM
MULTIFAMILY RESIDENTIAL TO CONDITIONED GENERAL
COMMERCIAL ZONING; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the owner of a 0.6608 acre tract of land out of Block 10, Denton
County School Lands, League 1. Abstract 58, Wichita County, Texas also being north
of the Cingular Wireless property, 4300 Kell Blvd, desires to rezone such tract; and
WHEREAS, the Planning and Zoning Commission recommended rezoning this
property and amending the Land Use Plan to conform to the rezoning; and
WHEREAS, the City Council finds that this rezoning request and amending the
Land Use Plan amendment to conform to the rezoning are in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City of Wichita Falls Land Use Plan, an element of the
Comprehensive Plan for the City of Wichita Falls, Texas is hereby amended for the
0.6608 acres out of Block 10, Denton County School Lands, Wichita Falls, Texas. Said
property is shown on the attached map, incorporated in this ordinance as Attachment
"A" and more fully described in the attached field notes incorporated into this ordinance
as Attachment "B." Said property land use designation shall be changed from High
Density Residential to Commercial.
SECTION 2. Said property being the same as described in Section 1, is hereby
zoned General Commercial Conditioned zoning, and regulated as follows:
GENERAL COMMERCIAL CONDITIONED ZONING DISTRICT GC(c)
A. The following uses are permitted in the GC(c) district:
Residential Uses
- Dwelling, Duplex, Two - Family
Dwelling, Single - Family Detached
Group Home
B. The following uses are permitted in the GC(c) district subject to the Site Plan
review provision of Section 7100 of the Zoning Ordinance:
Residential Uses
- Condominium, Residential
- Dwelling, Multifamily
- Dwelling, Zero Lot -Line, Single Family
- Townhouse
- Convalescent Service
Civic Uses
- Day Care Center, Limited and Commercial
- Library, Public
- Parks
- Public Safety Service
- Religious Assembly
- School, Primary and Secondary
Commercial Uses
Parking Lot or Facility
The following are permitted in the GC(c) District subject to the conditional use approval
process provided in Section 7200.
- Alcoholic Beverage Sales
- Art Gallery and Museum
- Convenience Store
- Business and Trade School
- Hospital
- Hotel
- Indoor Sports and Recreation
- Medical Office
- Movie Theater
- Nursery
- Office
- Restaurant
- Retail Trade

Note: The development regulations for this General Commercial Conditioned district
shall be the same as the General Commercial Zoning District, Section 3490 of the
Zoning Ordinance.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
