Ord 63-2010 11/16/2010 ORDINANCE NO. 63-2010 Ordinance Of The City Council Of The City Of Wichita Falls, Texas, Amending Subsection A Of Section 6.10, "Lots And Setbacks", Of Appendix A Of The City Of Wichita Falls Code Of Ordinances To Allow Lots Separated From Public Streets Only By A Strip Of Land Used For Utility, Pipeline, Or Railroad . Purposes To Be Platted Without Street Frontage WHEREAS, the City Council recognizes the need to add specific situations where it is appropriate to allow the platting of lots with no street frontage contingent upon an access easement on the adjacent property; and WHEREAS, the City Council concurs with Staff's recommendation to amend the Subdivision Ordinance to allow the platting of lots with no street frontage contingent upon an access easement on the adjacent property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Subsection A of Section 6.10, "Lots and Setbacks", of Appendix A of the City of Wichita Falls Code of Ordinances is hereby amended to add the underlined text and strike the stricken text, to read as shown below: A. All lots shall have access to, and front on a public street unless otherwise approved as required herein. Lots designated for storm water detention shall not be required to front on a public street, but shall be accessed by approved easements. Once so shown and described on a final plat, such lot shall not thereafter be used for other than as intended unless approved by the Planning Division and Department of Public Works. Lots separated from a street riqht-of-wa r�by a strip of land owned bv: 1. a utility used for the sole purpose of providinq utilities, 2. a pipeline company, used for the sole purpose of transportinq liquids, or 3. a railroad companv, used for the sole purpose of transport, shall not be required to front on a public street, provided that a permanent easement is obtained from the aforesaid utility company, pipeline company or railroad company providing for vehicular access between the lots and the public street.
