Ord 25-2010 4/20/2010 ORDINANCE NO. 25-2010 Ordinance Of The City Council Of The City Of Wichita Falls, Texas, Abandoning An Approximately 3,660 Square Foot Alley Behind 3111 — 3117 Avenue S, Subject To The Retention And Dedication Of Utility And Drainage Easements In The Area WHEREAS, Rick Neas, owner of 3111 — 3117 Avenue S, has requested the City close, vacate and abandon said alley located behind said property, also known as the Lots 1- 9, Block 8, Highland West Side; and WHEREAS, all affected utility companies and City departments have reviewed this request and have recommended conditional approval to close, abandon, and vacate this alley, subject to retention and dedication of drainage and utility easements therein; and WHEREAS, it has been determined to be in the best public interest to close, vacate, and abandon said alley as herein indicated on the attached Location Map and Photo. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. The alley located behind 3111 — 3117 Avenue S, as described above and as depicted in the attached Location Map and Photo, consisting of approximately 3,660 square feet, is hereby closed, abandoned, and vacated, subject to retention and dedication of drainage and utility easements in the area as described in the attached Depiction of Drainage and Utility Easement to be Retained. 2. In consideration of the receipt of $1,098.00 for the cost of the property and $200.00 for the cost of the appraisal and the retention and dedication of drainage and utility easements in the area as described in the attached Depiction of Drainage and Utility Easement to be Retained, this ordinance shall approve the closure of the aforementioned alley. 3. The City Manager is authorized to execute all documents necessary to memorialize the aforementioned abandonment and dedicated and retained easements.
