Property j Line of Milby Ave. and to end of Pavement 50 ft.south of Fain St. Said portions of said streets and avenues shall be improved by raisin-, grading and by filling; same, and by installing; cement concrete curbs and -utters, and storm sewers and drains where necessary, and by paving with one or more of the following types of materials, to-wit: Quadruple inverted penetration asphalt pavement; Texas State Highway Department Type Q-modified-Asphalt pavement; Blended Rock asphalt pavement; all of which tv es of pavement shall be laid on a flexible base. The exact type of pavement shall be selected by the Board of Aldermen of the City of Wichita Falls, Texas, after receiving bids for the doing of the required labor and the furnishing of the required materials in accordance with the plans and specifications to be prepared as herein ordered. (Unless otherwise noted on plans and specifications, existing; intersection paving, if any, will not be disturbed.) That a public necessity exists for the improving of the following public highways and streets in the City of WictiitaFalls, Texas, as hereinafter provided, to-?grit: UNIT 562 Arthur St. from So. Property Line of Ave. S to N. R/Fdd of Wichita Valley RR. UNIT 57, Burnett-Bluff Ailey from So. Property Line of Sixth St. to N. property line of Seventh at. Said portions of said streets and avenues shall be improved by raising, grading, and by filling same, and by installing cement concrete curbs and gutters, and storm sewers and drains where necessary, and by paving with one or more of the followin- types of materials, to-wit: Reinforced concrete paving in accordance with the plans and specifications to be prepared as herein ordered. The City Manager is hereby directed to have plans and specifications prepared for such improvementj. The City 1,1anager is hereby directed to have estimates of cost of such improve- ments before the hearing relating hereto is held and before any of such improve- ments are actually constructed. Payment for such improvements shall be made in the following manner: 919 (a) Hailways using, occupying or crossing any portion of said streets and avenues to be improved shall pay for and be assessed for all the cost of work in the area between their rails and tracks, double tracks, turn--cuts, and switches, and two (2) feet on each side thereof. (b) The abutting property and owners thereof shall pay and, shall be assessed for all the cost of constructing curbs and -utters in front of such respective property and a part of the remaining cost of such improvements, after deducting the amounts to be paid by railway companies under sub-paragraph (a) above, provided that such part of the costs assessed to the abutting property or the owners thereof shall in no case exceed 75% of the cost of the improvements plus the cost of the curb ana (;utter, it being herein set forth that this resolution is intended to include all the rights, powers, and privileges allowed a city under the provisions of Articic 1105 B, Vernon's Civil Statutes of Texas, and in cases where it is not satisfactorily shown to the Board of Aldermen of the City of Wichita Falls, Texas, that it will be inequitable to do so, the proportionate share of each property, or the ovrners thereof, jhall be assessed ana borne on the Front Foot Basis, and in any case where the Board of Aldermen of the City of Wi.cr:ita Fails, Texas, shall find that such plan or basis would result in injustice or inequality, the said Board of Aldermen shall apportion and assess such costs in such proportion and in the manner as it may deem just and equitable, having in view the special benefits in enhanced value to be received by such parcels of property and the owners thereof, the equities of such owners, and the adjustments of such apportionment so as to pro- duce a substantial equality of benefits received and burdens i npesed. (c) The remaining cost of said improvements, after deducting the sum finally assessed against the railway companies, as provided in sub-paragraph (a) hereof, and against the abutting property and owners thereof under sub-paragraph (b) hereof, shall be paid by the City of ?ichita Falls. Assessments made and levied shall be a first and prior lien and personal liability for principal, interest, reasonable attorney►s fees and costs of collection, if any incurred, on the rroperty assessed, superior to all other Liens and claims, except "State, county, school district and city ad valorem taxes, and shall be a personal liability and charge against said owners of the property assessed. St. be accepted, with Wichita Co. furnishing and delivering sandstone for a base for said paving in the amount of $1842.50, and authorizing the City Manager, F rark Wood, to sign a contract with Roden Construction Co.. for and on behalf of the City of Wichita Falls, for this amount. Moved by Alderman Putman that the City Manager, Frank Wood, be authorized to sign a contract for and on behalf of the City of Wichita Falls, with Roy Bowling and Aulcy Thorn for concession rights in the City Parks of Wichita Falls during 1951, and providing a payment to the City of 200 of gross receipts for said rights. Motion seconded by Alderman Parish anal carried. Moved by Alderman Abbott that the report of City Manager Frank Wood, in connection, with a collision at 1Cth $c Lamar St. on December 6, 1950, of a city-Owned fire truck and an automobile cvmed by Claude Cheatham, be accepted and payment of alleged damages to Claude Cheatham be refused. Kotion seconded by Alderman Putman and carried. Moved by Alderman Putman that the report of City Attorney J. Walter Friberg in connection with the claim of 11. E. kcDonald for hospital and medical expense be accepted and payment by the city on said claim be refused. Motion seconded by Alderman Abbott and carried. :Moved by Alderman Putman that City tanager Frank Wood be authorized to secure plans and specifications for bids to erect a fire station at Avenue X and Buchanan. Motion seconded by Alderman Broom and carried. 923 Action on a petition to create a fire lane in the 1500 block on 22nd Street, was deferred to the next meeting of the Board of Aldermen. The City manager, Frank Wood, aas instructed to check the bus service furnished by Wic:iita City Lines Inc. to residents on the east side of torn affected Ivy the recent abandonment of their East Side bus route. Moved by Alderman Brown that the resignation of R. Mills Tittle as Chairman of the Citizens Committee be accepted, and that the members of the Citizens Committee be allowed tc name Mr. Tittle's successor. Motion seconded by Alderman Abbott and carried. Moved by Alderman Abbott that R. Mills Tittle be commended for his out- standing work as Chairman of the Citizens Committee. Motion seconded by alderman Parish and carried. Moved by Alderman Parish that the request of the Checker Cab Co. for five (5) additional taxicab permits to operate in Wic�:ita Falls be refused. Motion seconded by Alderman Brown and carried. Moved by Alderman Abbott that action on the re-instatement of taxi driver's permit of W. G. Hatfield, be deferred, until City Manager Frank Wood have sufficient time to investigate this matter. Motion seconded by Alderman Putman and carried.
