Alderman B. C. Hunter made a motion that the resolution be adopted finally. The motion was seconded by Alderman Lloyd C. Thomas. The resolution as adopted is as follows: RESOLUTION NO. 42 BY THE BOARD OF ALDERVIII1 OF THE CITY OF WICHITA BALLS, TEXAS, CALLING AN ELECTION ON THE QUESTION OF THE ISSUANCE OF $1,250,000.00 WATERWORKS BONDS; ON THE QUESTION OF THE ISSUANCE OF $800,000.00 STREET IMPROVEMENT BONDS; ON THE QUESTION OF THE ISSUANCE OF $2003000.00 PARK BONDS; ON THE QUESTION OF THE ISSUANCE OF $100,000.00 FIRE STATION BONDS AND ON THE QUESTION OF THE ISSUANCE OF $900,000.00 SEWER REVENUE BONDS, WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, deems it advisable to issue the bonds of said City for the purposes hereinafter mentioned; BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: 1. That an election be held in said City of Wichita Falls,Texas, on the 6th day of December, 1949, at which election the following propositions shall be submitted: PtiOPOSITION NO. 1 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the bonds of said City in the amount of $1,250,000.00, maturing serially in such in- stallments as may be fixed by the Board of Aldermen, the mari- mum maturity date being not more than Twenty Five (25) years from their date, and bearing interest at a rate not to exceed Three and one-half (31%) per cent per annum, payable annually 707 4 L - i Y 1 or semi-annually, and to levy a tax sufficient to pay inter- est as it accrues and principal as it matures on said issue of bonds, for the purpose of constructing, repairing, improv- ing and extending the water works of said City, as authorized by the Constitution and laws of the State of Texas.11 PROPOSITION NO. 2 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the bonds of said City in the amount of $800,000.00, maturing serially in such in- stallments as may be fixed by the Board of Aldermen, the maxi- mum maturity date being not more than Twenty Five (25) years from their date, and bearing interest at a rate not to exceed Three and one-half (321%) per cent per annum, payable annually or semi-annually, and to levy a tax sufficient to pay inter- est as it accrues and principal as it matures on said issue of bonds, for the purpose of constructing permanent street improvements within said City, as authorized by the Consti- tution and laws of the State of Texas." i PROPOSITION NO. 3 i . "Shall the Board of Aldermen of the City of Wichita j Falls, Texas, be authorized to issue the bonds of said City in the amount of $200,000.00, maturing serially in such in- i stallments as may be fixed by the Board of Aldermen, the maxi- mum maturity date being not more than Twenty Five (25) years from their date, and bearing interest at a rate not to exceed Three and one-half DL%) per cent per annum, payable annually or semi-annually, and to levy a tax sufficient to pay inter- est as it accrues and principal as it matures on said issue of bonds, for the purpose of improving lands for park purposes, � as authorized by the Constitution and laws of the State of Texas." PROPOSITION NO. 4 !, i "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the bonds of said City in the amount of $100,000.00, maturing serially in such in- stallments as may be fixed by the Board of Aldermen, the maxi- mum maturity date being not more than Twenty five (25) years from their date, and bearing interest at a rate not to exceed Three and one-half (31p) per cent per annum, payable annually or semi-annually, and to levy a tax sufficient to pay inter- est as it accrues and principal as it matures on said issue of bonds, for the purpose of constructing, repairing and im- proving fire stations within said City, as authorized by the Constitution and laws of the State of Texas.11 PROPOSITION NO. 5 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the bonds of said City in the amount of $900,000.00, maturing serially in such in- stallments as may be fixed by the Board of Aldermen, the maxi- mum maturity being not more than Twenty Five (25) years from their date, bearing interest at a rate not to exceed Three and one-half (32%) per cent per annum, for the purpose of constructing, repairing, improving and extending the sanitary sewers of said City, to be issued in accordance with and securing in the manner provided in Articles 1111-1118, both inclusive, of the Revised Civil Statutes of Texas, 1925, as amended, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obli- gation out of funds raised or to be raised by taxation, secur- ed by a pledge of the net revenues from the operation of said system.'? 2. The said election shall be held within the City of Wichita Falls, Texas, at the several voting places and the follov,,2ng persons are hereby appointed directors of said election: (a) In City Voting Precinct No. 1 at the Bailey Meissner Company, 1101 Lamar Street, with E. C. Moore as Presiding Judge; All qualified property taxpaying voters who reside in that portion of County Voting Precinct No. 6 which lies within the City shall vote in City Voting Precinct No. 5, at the Doolen Pharmacy, with G. W. Pond as Presiding Judge; All qualified property taxpaying voters who reside in that portion of County Voting Precinct No. 7 which lies within the City shall vote in City Voting Precinct No. 6, at the Washington School, with A. Busse- as Presiding Judge; All qualified property taxpaying voters who reside in that portion of County Voting Precinct No. 41 which lies within the City shall vote in City Voting Precinct No. 22 at the Estep Pharmacy, with Mrs Helen Arbuckle as Presiding Judge; 709 All qualified property taxpaying voters who reside in that portion of County Voting Precinct No. 43 which lies within the City shall vote in City Voting Precinct No. 23 at the Ben Franklin School, with W. S. White as Presiding Judge; All qualified property taxpaying voters who reside in that portion of County Voting Precinct No. 45 which lies within the City shall vote in City Voting Precinct No. 24 at the Westover Hills Community House, with Fred L. Cone as Presiding Judge; All qualified property taxpaying voters who reside in that portion of County Voting Precinct No. 47 which lies vrithin the City shall vote in City Voting Precinct No. 25 at the Carrigan School, with C. L. r;urph as Presiding Judge. The Presiding Judges hereinabove named for each voting, i precinct shall appoint such additional clerks as may be needed to conduct such election. 3. The said election shall be held under the provisions of Chapter 1, Title 22, of the Revised Civil Statutes of 1925, as amended, including the provisions of Article 704, as amended by Chapter 382, passed at the First Called Session of the Forty Fourth Legislature, and only legally qualified electors who own taxable property in the City and who have duly rendered the same for taxation shall be qualified to vote at said election and all electors shall vote in the election precinct of their residence. 4. The ballots of said election shall have written or printed thereon the following; PROPOSITION NO. 1 . "FOR THE ISSUANCE OF WATERWORKS BONDS11 "AGAINST THE ISSUANCE OF WATERWORKS BONDS" PROPOSITION NO. 2 "FOR THE ISSUANCE OF STREET IMPROVEMENT BONDS" "AGAINST THE ISSUANCE OF STREET IMPROVEMENT BONDS" PROPOSITION NO. 3 "FOR THE ISSUANCE OF PARK BONDS" "AGAINST THE ISSUANNCE OF PARK BONDS" PROPOSITION NO. 4 "FOR THE ISSUANCE OF FIRE STATION FONDS" "AGAINST THE ISSUANCE OF FIRE STATION BONDS" PROPOSITION NO. 5 "FOR THE ISSUANCE OF SEWER REVENUE BONDS" "AGAINST THE ISSUANCE OF SZVI.HR REVENUT BONDS" Concerning each of said propositions each voter shall mark out with black ink or black pencil one of the above expressions, thus leaving the other as indicating his vote on the proposition. 5. A substantial copy of this resolution signed by the Mayor of said City and attested by the City Clerk shall serve as proper notice of said election. Notice shall be given in accordance with Article 704, Re- vised Civil Statutes of 1925, as amended by Chapter 382, passed at the First Called Session of the Forty Fourth Legislature, supra. The Mayor is authoriz- ed and directed to have a copy of said notice posted at the City Hall and at a public place in each of the voting precincts within said City, not less than fifteen days prior to the date fixed for holding said election. He shall also cause said notice to be published on the same day in each of two successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen days prior to the date set for said election. Except as otherwise provided in said Article 704, as amended, the manner of holding said election shall be governed by the laws governing general elections. i 710 RESOLUTION NO. 43 A RESOLUTION OF THE BOARD OF ALDERMEN OF THE CITY OF ?;TICHITA FALLS, TEXAS, ADOPTING THE RECOMMENDATIONS OF THE CITIZENS COM- MITTEE ^JITH R3PECT TO PUBLIC IMPROV�U.MNTS FOR WATER, FIRE PROTEE'CTICN) STP 1ZTS, SEWAGE AND PARKS: WHEREAS, an election has been called by the Board of Aldermen of the City of Wichdta Falls for the purpose of determining whether or not the qualified voters of said city desire to approve the issuance of Bonds for the purposes set out in the Resolution calling such election, �+ AND, WHEREAS, a number of citizens interested in the wel- fare of the citizenship of the City of Wichita Falls and in the pro- gress of the city have been formed into a Citizen's Committee for the purpose of making recommendations to the Board of Aldermen of the City of Wichita Falls regaraing the expenditure of funds received by the issuance and sale of bonds if same are approved; AND, WHEREAS, a completed detail report has been received by the Board of Aldermen and has been filed in the office of the City Clerk; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: That we will carry out and fulfill the program of the Citizen's Committee with despatch and that all projects set out in their recommenda- tions shall be carried out and fulfilled as recommended. That if any project set out in the report of the Citizen's Committeeshould be abandoned for any reason, such funds as shall have been allocated to such project abandoned shall not be used for any other purpose but must be transferred to the interest and sinking fund for the purpose of paying interest and retiring principal of the Bonds. ALSO, THAT WHEREAS, all of the monetary allocations set out in the recommendations of the Citizen's Committee are based on engineer's estimates, therefore, if one project exceeds the estimated cost and other project;, are built for a lessor cost than estimated such savings effected thereby may be used at the discretion of the Board of Aldermen within the particular department wherein such overs and unders occur. Moved by Alderman Abbott that the above and foregoing Resolution be adopted and passed as read. Mayor Harold Jones announced that the proposed Amended Ordinance for the support of the City Government for the fiscal year beginning October 1, 1949, and ending September 30, 1950, was open for discussion by the public, as well as theCouncil. There being no opposition to the same, the following motion was had: Moved by Alderman Hunter that the public hearing on the above and foregoing be closed. Motion seconded by Alderman Abbott and unanimously carried. 711 ORDINANCE NO. 1507 AN ORDINANCE AMENDING ORDINANCE NO.1504 PASSED AND APPROVED ON NOVEMBER 71 1949, ENTITLED "AN ORDINANCE MAKING APPROPRIATION FOR SUPPORT OF THE CITY GOV'�'dMENT FOR FISCAL YEAR BEGINNING OCTOBER 1, 1949, AND ENDING SEPTb- BER 30, 1950." Moved by Alderman Hunter that Ordinance No. 1507 be approved and passed as read on its first reading. Motion seconded by Alderman Ray and carried by the following vote: Yeas: Aldermen Abbott, Ray, Thomas, Brown, Parish and Hunter. Nays: None. I Motion seconded by Alderman Ray and unanimously carried. 712 Moved by Alderman Abbott that the Board of Aldermen approve and authorize the issuance of a permit to D & F Motor Co. Inc. in the State of Texas, to operate six driverless automobiles upon the streets of the City of Wichita Falls and not to exceed 25 driverless automobiles at any one time; it being distinctly understood that the said D & F Motor Co. Inc. shall homily at all times with the provisions and requirements set forth in the ordinance governing the issuance of permits for driverless automobiles. Motion seconded by Alderman Ray and carried. Moved by Alderman Ray that the Board of Aldermen approve and authorize use of the Memorial Auditorium, free gratis, to the Wichita County Veterans Council on December 7, 1949, for a free program with slogan «Democracy Beats Communism." Motion seconded by Alderman Hunter and carried. Moved by Alderman Hunter that use of the Memorial Auditorium be furnished, i free gratis, to the Wichita Falls Symphony Society for the purpose of instructing and promoting musical education of the youth of the City, when and at such time as may be requested by Mr. Frederick Balazs, Conductor, or Mrs J. W. Akin. Motion seconded by Alderman Abbott and carried. Moved by Alderman Parish that the Board of Aldermen approve and authorize payment to the G & G Tank Trucks of Holliday, Texas, and the North Side Girls Club the sum of $45.00 for oiling streets in the vicinity of North Side Girls Club, by virtue of the fact that the Water Department laid a water main along the side of the North Side Girls Club, thus destroying the value of the oiled street pre- viously laid; and further to direct the City Clerk to draw a warrant. for the same out of the Water Fund. Motion seconded by Alderman hay and carried. Moved by Aide raariBrown that the Council concur with the contents of a letter of commendation written to Mr. Joe E. Ward by the local Water and Sewage study groups of the Citizen's Conmittee, and that a copy of the same be spread upon the Minutes, as hereinafter set forth. JOINT RESOLUTION OF THE WATER STUDY GROUP AND THE SEWAGE STUDY GROUP OF THE CITIZENS COMMITTEE Respectfully submitted to the General Committee; WHEREAS, both the Water Study Group, headed by Chairman R. Mills Tittle, and the Sewage Study Group, headed by Chairman Grover Bullington, both individually and in joint Committee sessions, had an opportunity to sti:dy the comprehensive Survey of Water and Sewage Needs for the City of Wichita Falls made by Joe E. Ward, Con- sulting engineer of Wichita Falls, and, WHEREAS, the Committees have found this survey, together with its recommendations, to be of outstanding a.1rcellence and commendably thovough in every detail, and, vai,EHEAS, the Coninittees recognize the fact that such a study could not have been accomplished without the expenditure of considerable time, effort, money and personal attention, all of which were contributed by `ir. :%ard, at no expense to the City of Wichita Falls. NOW, THEREFORE, BE IT RESOLVED that the Water Study Group and the Sewage Study Group, individually- and jointly, request the General Citizens Committee to express to "-Lr. Joe E. Ward and his associates their appreciation for his splendid public service and personal intarest in the welfare of his City, and that the General Committee transmit this resolution to the '°aiciiita Falls City Council, in order that our City officials iniLht know the genuine appreciation these Committees feel toward Joe E. The Minutes of the regular meeting held October 24, 1949, were read and unanimously approved as read; likewise the Minutes of the called meeting held November 7, 1949, were read and unanimously approved, as corrected.
