The Board of Aldermen of the City of Wichita Falls, Texas, met in regular
session in the Council Room of the Memorial Auditorium Building at 8:00 o'clock
P. M. on the above date, with the following members present:

The Minutes of the Meeting held May 9, 1949., were read and approved as
corrected; likewise the Minutes of the called meetings held May 19th and May 20�h,
1949, respectively., were read and approved as read,

Moved by Alderman Abbott that the Board of Aldermen approve and accept
the insurance policies of Lloyd's of Houston, submitted by Checker Cab Co. and
Yellow Cab Co.
in lieu of theJr cash taxicab deposits now on deposit with the
City of Wichita Falls, providing however, the said Checker Cab Company and
Yellow Cab Company leave their taxicab cash deposits now on deposit with the City
of Wichita Falls for a period Of six months from date hereof.

Moved by Alderman Parish that the Board of Aldermen approve and adopt
the Plat and Dedication of the East Morningside Addition to the City of Wichita
Falls, a copy of which is attached hereto and made a part of the records hereof.
Motion seconded by Alderman Hunter and carried.
Moved by Alderman Ray that the Board of Aldermcn approve and adopt the
Re-plat and Dedication of College Heights., a Subdivision of Highland and Kemp &
Kell Additions to the City of Wichita Falls, a copy of which is attached hereto
and made a part of the records hereof.
Motion seconded by Alderman Hunter and carried.

the owners Of 12.5115 acres Of land situated in and adjoining the
City Of Wichita Falls, Wichita County, Texas, and fully described in
a deed from Lemma K. Boone, individually gnd as executrix of the
estate of T. R. Boone deceased, et al to Paul M. Thiem Jr. dated
January 15, 1949 and recorded in Volume 495 Page 257 of the Deed
Records Of Wichita Countys Texas to which reference is here made
for full particulars and description, do hereby adopt this plat
which is made a part of
known as "EAST MORNINGS1 this as the Map and Plat Of, which is to be
Wichita County, Texas. DE ESTATES" to the City of Wichita Falls,
And they do hereby dedicate to the public the streets
and alleys as shown on said Plat and will hereafter convey the said
lands by the lot and block numbers as shown on said Plat by which
numbers said subdivision of said lands shall hereafter be known.
The sale of all lots shall be subject to certain building
restrictions as hereinafter set out, as well as the other restric-0
tions hereinafter mentioned,gs follows:
1- NO lot shall be used except for residential purposes.
No building shall be erected, altered, Placed, or permitted to re-
main on any lot other t',an one detached single family dwelling not
to exceed one story in height and a private garage for not more
then two cars,
2. No building shall be located on any lot nearer to the
front lot line or nearer to the side stre et line than the minimum
building setback lines shown on the re corded plat. In any event no
buildinQ
9 shall be located on any lot nearer than twentY-five feet
to the front lot line or nearer than ten feet to any side street
line. No building shall be located nearer than five feet to an
interior lot line# except that no side yard shall be required.for
a garage located thirty-five feet or more from the minimum build-
Ing set-back line. For the Purpose of this covenant, eaves2 steps..
and open porches shall not be considered as a Part Of a building,
provided however I
., that this shall not be construed to permit any
Portion of a building on a lot to encroach upon another lot.
3. No lot shall be resubdivided into, nor shall any dwelling
be erected or Placed on, any lot having a width of less than fifty
feet at the minimum building set-back line. All lots in subdivision
shall have a minimum lot area of 6, 250 sq. ft.
4. Easements for installation and maintenance of utili-
ties and drainage facilities are reserved as shown on the recorded
plat.
5. No noxious or offensive activity shall be carried
on upon any lot, nor shall anything be done thereon which may be
or may become an annoyance or nuisance to the neighborhood.
6. No structure of a temporary character, tritiler,
basement, tent, shack, garages barn, or other outbuilding shall
be used on any lot at any time as a residence either temporarily
or permanently. No old building shall be moved on to any of the
lots within this subdivision.
The herein covenants are to rum with land and shall be
binding on all parties and on persons claiming under them until
January lst. 1 1980p at which time said covenants shall be automa-
tically extended for successive periods of 10 years unless by
vote of a majority of the then owners of the lots it is agreed to
change said covenants in whole or in part.
Enforcement shall be by proceedings at law or in equity
against any person or persons violating or attempting to violate
any covenant either to restrain violation or to recover damages.
Invalidation of any one of these covenants by judgement
or court order shall in no wise affect any of the other provisions
which shall remain in full force and effect.
