Min 05/23/1949 648 Wichita Falls, Texas Memorial Auditoriut Building May 23, 1949 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session in the Council Room of the Memorial Auditorium Building at 8:00 o'clock P. M. on the above date, with the following members present: Harold Jones Mayor L. R. Abbott Lloyd C. Thomas Roy W. Parish J. R. Ray Aldermen Berry Brown B. C. Hunter Geo.T. Henderson Cit y Clerk Frank Wood City Manager Guy H. McNeely City Attorney Mr. J. R. Farabee gave the Invocation. The Minutes of the Meeting held May 9, 1949., were read and approved as corrected; likewise the Minutes of the called meetings held May 19th and May 20�h, 1949, respectively., were read and approved as read, - - - - - - - - - - Moved by Alderman Abbott that the Board of Aldermen approve and accept the insurance policies of Lloyd's of Houston, submitted by Checker Cab Co. and Yellow Cab Co. in lieu of theJr cash taxicab deposits now on deposit with the City of Wichita Falls, providing however, the said Checker Cab Company and Yellow Cab Company leave their taxicab cash deposits now on deposit with the City of Wichita Falls for a period Of six months from date hereof. Motion seconded by Alderman Ray and carried. - - - - - - - - - - Moved by Alderman Parish that the Board of Aldermen approve and adopt the Plat and Dedication of the East Morningside Addition to the City of Wichita Falls, a copy of which is attached hereto and made a part of the records hereof. Moved by Alderman Ray that the Board of Aldermcn approve and adopt the Re-plat and Dedication of College Heights., a Subdivision of Highland and Kemp & Kell Additions to the City of Wichita Falls, a copy of which is attached hereto and made a part of the records hereof. No lot shall be resubdivided into, nor shall any dwelling be erected or Placed on, any lot having a width of less than fifty feet at the minimum building set-back line. All lots in subdivision shall have a minimum lot area of 6, 250 sq. ft. 4. Easements for installation and maintenance of utili- ties and drainage facilities are reserved as shown on the recorded plat. 5. No noxious or offensive activity shall be carried on upon any lot, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. 6. No structure of a temporary character, tritiler, basement, tent, shack, garages barn, or other outbuilding shall be used on any lot at any time as a residence either temporarily or permanently. No old building shall be moved on to any of the lots within this subdivision. The herein covenants are to rum with land and shall be binding on all parties and on persons claiming under them until January lst. 1 1980p at which time said covenants shall be automa- tically extended for successive periods of 10 years unless by vote of a majority of the then owners of the lots it is agreed to change said covenants in whole or in part. Enforcement shall be by proceedings at law or in equity against any person or persons violating or attempting to violate any covenant either to restrain violation or to recover damages. Invalidation of any one of these covenants by judgement or court order shall in no wise affect any of the other provisions which shall remain in full force and effect.
