Min 05/09/1949 639 Wichita Falls, Texas Memorial Auditorium Building May 9, 1949 I i The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session in the Council Room of the Memorial Auditorium Building at 8:00 o'clock P. M. on the above date, with the following members present: Harold Jones Mayor L. R. 9bbott Roy W. Parish J. R. Ray Aldermen Berry Brown B. C. Hunter Geo. T. Henderson City Clerk Frank Wood City Manager Guy H. McNeely City Attorney The Minutes of the regular meeting held April 25, 1949, were read and approved as read; likewise the Minutes of the called meetings held April 26, April 28, and April 29, 1949, respectively, were read and approved as read. Mr. Shappell came before the Council seeking information as to the procedure for constructing a water main in Lakeside Park Addition. Mr. Shappell stated residents in that area had subscribed approximately $21,200.00 for the construction of a water main in Lakeside Park Addition and requested the City to pay part of the construction cost. By common consent of the Council, the matter was referred to the City Manager and J. P. Ruhnann, Water Supt., for specific plans and cost of construction of a water main in Lakeside Park Addition, and a report on same to the Council. Attorney Ralph Mathis came before the Council seeking a permit for the Southwestern Bell Telephone Company to erect a three-story building on 9th Street directly west of the alley back of the Telephone Building with an over-head bridge passage-way over the alley between the present telephone building and the proposed new building. The City Attorney was directed to prepare an ordinance providing for such construction and submit the same to the Council for further consideration. May 9, 1949 Honorable Mayor & City Aldermen City of Wichita Falls Wichita Falls, Texas Gentlemen: I, J. H. York, doing business as Checker Cab Company, have secured public liability insurance to indemnify the public for damages resulting by reason of the operation of my taxi cabs. I have on deposit with the City Clerk the sum of $3,500.CO at this time, which said sum was placed with the Clerk for the purpose covered by the insur- ance at this time. York Honorable Mayor & City Aldermen May 9, 1949 City of Wichita Falls Wichita Falls, Texas Gentlemen: I, Glenn Krottinger, doing business as Yellow Cab Company, have secured public liability insurance to indemnify the public for damages resulting by reason of the operation of my taxi cabs. I have on deposit with the City Clerk the sum of $4,000.CO at this time which said sum was placed with the Clerk for the " purpose covered by the insurance at this time. Krottinger The above and foregoing written requests were presented to the Council, subsequently the same requests were presented verbally by Attorney Taz Locke. The matter was discussed by the Council at length, thereupon the matter was re- ferred to the City Manager for investigation and report on the same, together with his recommendation to the Council. Certain representatives of Hardin College again appeared before the Council requesting the installation of vapor lights on the college campus, there- upon the following motion was had: Moved by Alderman Ray that the City Manager be directed to authorize the Texas Electric Service Company to install twelve (12) lights on Hardin College campus and bill the City monthly with the light consumption, and direct the City Clerk to pay for the same out of the -Parkifig After Fund. Motion seconded by Alderman Parish and carried. John Upton, 301 N. Burnett St., complained to the Council that the Garbage Department was not hauling garbage from his grocery store building at 301 N. Burnett, neither was he paying the present garbage rate for hauling. He stated that he would pay $1.510 per month for garbage service, providing the City would haul the same at that rate. The matter was referred to the City Manager for investigation. Ben Conant, who resides at 2808 Colquitt, stated to the .Council that residents in the 2800 block on Colquitt Street had previously oiled the street, and at a later period the City had laid a 10 inch water main in the street, which completely destroyed the value of the oil, and requested the City to re-oil the same at its own expense, thereupon the following motion was had: Moved by Alderman Ray that a thorough investigation be made as to why the street in the 2800 block on Colquitt was not re-oiled by the City, thereby repairing the damage as alleged by Mr. Conant; and further that the City Authorities be directed to re-oil the said street in the 2800 block on Colquitt St., thus restoring the same to its original condition before the water main was laid. Motion seconded by Alderman Hunter and carried. 641 T. H. Francis (colored) appeared before the Council requesting a change in the liquor zoning ordinance so as to allow the sale of beer at the intersection of Texas and Walnut Street. No action was taken at this time. Moved by Alderman Parish that the Board of Aldermen adopt the Plat and Dedication of the First Supplemental Addition to Blackmon & Williams Third a' Addition to the City of Wic"lita Falls, Texas, same being attached hereto and made a part of the records hereof. Motion seconded by Alderman Abbott and carried. F. D. Kirkendoll again came before the Council relating the extreme dangerous condition in the vicinity of the High School due to reckless driving by certain High School students. Various members of the Council expressed a desire for improved traffic conditions, not only around the High School, but throughout the entire City, thereupon the following motion was had: Moved by Alderman Brown that the traffic situation be referred to the City Manager for investigation and study, with authority to employ such methods as may be necessary to remedy the deplorable condition. Motion seconded by Alderman Ray and carried. A Public Hearing was held on Ordinance No. 1489. There being no opposition voiced against the same, the following motion was had: Moved by Alderman Hunter that the Public nearing on Ordinance No. 1489 be closed. Motion seconded by Alderman Ray and carried. ORDINANCE N0. 1489 AN ORDINANCE EXTENDING THE CITY DIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING CERTAIN LAND ADJACENT TO THE PRESENT TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, THE SAME LYING IN A SOUTHERLY DIRECTION FROM THE PRESENT CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, ALL OF WHICH LANDS ARE FULLY DESCRIBED IN THE BODY OF THIS ORDINANCE AND DECLARING AN EMERGENCY. Moved by Alderman Ray that Ordinance No. 1489 be approved and passed as read on its first reading. Motioh seconded by Alderman Hunter and carried by the followdng vote: Yeas: Aldermen Abbott, Parish, Ray, Brown and Hunter. Nays: None. THE STATE OF TEXAS COUNTY OF WICHITA � TO THE HONORABLE CITY COUNCIL OF WICHITA FALLS, TEXAS: As you no doubt know, the water supply of the Town of Archer City, Texas, has been exhausted and unless an immediate supply of water is obtained for our town the town may suffer irreparable damages; therefore, We, the City Council of the Town of Archer City, Texas, respectfully request you, as the Managing body of Wichita Falls, Texas, to supply water to us from Lake Kickapoo by letting water from such Lake into little Wichita River from where we can pump the same to our town; the amount of water that we desire you to supply us is approximately 300,000 gallons per day or whatever can be delivered through a 4 inch line which we are laying to the River and which line is approximately 24,000 feet in length. 642 + r- If this honorable Council sees fit to supply us with such water, we agree to pay whatever rate you set for such water and to assume all liability and responsibility and expense arising from your furnishing us such water. An emergency exists and your prompt and favorable action on this matter will be appreciated not only by the Council but by all citizens and residents of Archer City, Texas, and the surrounding area. Fall, Mayor and others The above and foregoing request from the Mayor et al at Archer City was read to the Council, thereupon the following motion was had; Moved by Alderman Hunter that the City of Wichita Falls furnish raw water to Archer City from Lake Kckapoo, free gratis, for a period of thirty days, providing the said Archer City does not sell water for industrial pur- poses outside of the City; with further provisions that the said Archer City shall transport water at its own expense and without liability to the City of Wichita Falls. Motion seconded by Alderman Ray and carried. The statement of the Wichita County Water Improvement District No. 2 against the City of Wichita Falls for delinquent taxes for the years 1947 & 1948, aggregating the sum of $1056.00, covering certain city-owned land in the vicinity of the Secondary water reservoir, was referred to the City Attorney for an opinion as to whether or not the City is actually required to pay this tax. Moved by Alderman Ray that the Board of Aldermen authorize the issuance of a permit to Ward's Cut Rate Liquor Store for the purpose of in- stalling an air-conditioner on the outside of the building located at 728 Ohio Street, for a period of time not to exceed October 1, 1949, Pro- viding the same is installed under the direction of the City Engineer. Motion seconded by Alderman Hunter and carried. Moved by Alderman Ray that the Board of Aldermen authorize the issuance of a permit to J. B. McMahon for the purpose of installing two air- ccnditioners at 716 Ohio Street, for a period not to exceed October 1, 1949" providing the same are installed under the direction of the City Engineer. Motion seconded by Alderman Hunter and carried. Moved by Alderman Ray that the Board of Aldermen authorize the issuance of a permit to G. D. Crockett to install a neon sign, between the curb and the sidewalk, at the Crockett Service Station located at the corner of Sixth &Indiana Streets, for a period of one year, providing the same is installed in accordance with the recommendation and requirements of the City building and electrical inspector. Motion seconded by Alderman Parish and carried. 643 Moved by Alderman Brown that the Board of Aldermen authorize payment to Alderman Parish the sum of $14.13 to reimburse him for long distance telephone calls in connection with seeking a city manager for the City. Motion seconded by Alderman Abbott and carried. The claim of G. W. Russell as presented by Attorney J. R. Wilson, for alleged damages, in the amount of $2500.00, was read to the Council and promptly referred to the City Attorney for investigation. Moved by Alderman Parish that the Board of Aldermen meet in the Council Room of the Memorial Auditorium Building on Monday night at 7:00 o'clock P.M. May 16th for the purpose of appointing a tax Equalization Board for the year 1949. Motion seconded by Alderman Hunter and carried. Moved by Alde man Hurter that the meeting be adjourned.
